Update: according to the Everett Herald when he gets out of the hospital he will be booked for assault since he allegedly leveled the rifle at the police before they shot him according to police spokesperson. The 27 yo has a history of mental illness as well according to the article.

That they aren't charging the guy with aggravated assault on an officer with a deadly weapon just simple assault. There's a huge difference. simple assault is what you do when you threaten someone or create the apprehension of injury. Aggravated assault is when you actually cause harm or use a weapon in the commision of assault.

The fact that they haven't thrown the book at this guy... well... that's indicative of a bad shoot.

If they had something on the guy... he'd be getting charged with a LOT more than assault. Police are not known for going light on the charges they file... particularly if someone points a firearm at an officer.

If he didn't point the gun at them, if he didn't threaten them with bodily harm with it... they are thoroughly bubblegummed.

The more I'm reading on this the more its sounding like a bad shoot. If so... the police better pray that the guy is willing to settle.

If it's a bad shoot, hell, this'll be good for the police... maybe a few more trigger happy dirty harry wannabe's will be forcibly exited from the police force.
