My Name is Billy Seroyer and I live in Milwaukie Oregon and I oppose
SB 978, in particular I oppose section 14 of the dash 1 amendment of
the bill, UNDETECTABLE AND UNTRACEABLE FIREARMS. First and foremost
i'd like to point out that the Undetectable Firearms Act of 1988 has
already rendered undetectable firearms illegal on a federal level so
this amendment is already redundant. I'd also like to point out that
according the the AFT a unfinished frame or receiver is nothing more
then a block of Aluminum or steel, and as treated as such. Is the
state of Oregon going to start requiring home depot to get an FFL and
start conducting background checks and taking thumbprints of customers
that wish to buy blocks of Aluminum or Steel from them? As pertaining
to 3d printed firearms I ask the legislature how they plan on getting
OSP to enforce this law? Will they be serializing all 3D printers and
USB drives coming into Oregon and keeping track of when they are used?
Or will the state be using a Chinese style Intranet to block
Oregonians from the outside world? Throughout the 2000s Hollywood and
music industry tired to take down internet Piracy sites and failed
spectacularly. You can't stop something once its already on the
internet because the internet completely decentralized, mega.com, The
Pirate Bay, still exist and so do the CAD files for 3D printed
firearms.

Great first post! (and welcome to the forum) I also mentioned that I have seen people makes receivers from shovels and aluminum cans. Is Home Depot and Safeway going to start doing background checks?
 
That article is from 2008 and refers to the DC v Heller Supreme Court decision. The DC law that Heller found unconstitutional required firearms to be unloaded and have a trigger lock or be disassembled at all times, rendering the firearm useless for the self-defense role. The gun control advocates writing these new trigger lock bills are well aware of Heller so they include an exception for a functional firearm to be carried or under direct control of a person, or in a rapid-access locked container, which allows the firearm to be useful for self-defense, satisfying the requirements of Heller.
Just reading the summary seems to imply that they deemed any lawful firearm in the home to be free from trigger lock requirements. It doesn't say that the firearm has to be in direct control of a person. I would have to dig in to the decision to see if it addresses rapid access safes but that would seem to restrict the use of the firearm as well.
"Similarly, the requirement that any lawful firearm in the
home be disassembled or bound by a trigger lock makes it impossible
for citizens to use arms for the core lawful purpose of self-defense and
is hence unconstitutional"

I think the right makeup of the court would agree with my interpretation, the right case just needs to be heard:

Don't forget HB 2505 which has similiar firearm lock up provisions as SB 978.

I believe HB 2505 and similar lock up legislation are partially aimed at preventing non FFL transfers. If you transferred a firearm to somebody with out going through FFL and they used the firearm to injure or kill somebody. You would have to fess up to transferring with out FFL or claim the person stole it. Either way under the gun lock up laws you could be strictly liable for up to two years or face punishment for violationg SB 941.

Edit: First offenses for violating SB 941 is only a class A misdemeanor but 2nd time is Class B felony.
