  • Does she have an active CPL?
  • Will this be deemed brandishing?
  • If she has an active CPL, will she lose her CPL over it?

The employee asked her several times to leave because she didn't have a mask on. Police said Nommensen refused and got into a verbal argument.

According to police, the gas station employee escorted the customer outside and went back inside and that's when Nommensen flashed a gun at the worker.

"She pulled a handgun from a holster-- I think it was on her waist band-- and held it up," said Captain Darryl McKinney. "She said something to him and turned around a walked back to her car."

I do my best to avoid wearing a mask.

That said , I would not display or pull my concealed carry pistol , over having to wear a mask to be in a store.
Nor would I have allowed the situation to escalate to point of me being removed from the store.

Please note that I do not agree with the mandate / policy / decree etc...regarding the usage of masks.
I am just saying that the situation outlined in the OP does not warrant the use of a firearm.

And yeah I am sick ( pun intended ) and tired of anything COVID related....
So I can understand people being frustrated and unwilling to comply with all the rules , regulations and the like.
I think that a change in what and how we do things regarding COVID is needed and long over due.

I would suggest that one does not let their moment of frustration , cause a lifetime of problems.

Sadly again a LOT of stupidity on display. The clerk physically assaults her. Over a damn mask. The only reason the clerk is getting off on this is the woman was not a protected race. If he does this to someone else they will fire him and probably charge him.
The customer decided to be an asshat. I too think the mask thing is a joke. When I go to a business that wants them I put one on. Don't like it? Do not go to the place. If she had not pulled her gun after the clerk is trying to shut the door she could have asked him to be charged with assault. Now that she flashed a gun she will be lucky if they let this drop. Again all over some temper tantrum over a mask.

I wear a mask when I go to the grocery store simply because the last thing I want to do is argue with some Karen. Masks have no value with viruses, and It's stupidity to think they do. This is one of those "pick your battles" situations; it's easy enough to do, and if it prevents me from having to bit@h slap someone off their feet, it's a good thing......

Both idiots, both deserve the book thrown at them. "Fueling company car".... well, unless she's self employed, she probably just kissed that job goodbye, and the clerk is gearing up to sue her employer and reach onto those deeper pockets for a payday.

Also, the Internet Remembers... if it is her... and ohh, the irony. A Conflict Resolution/Communications major.... hahahahahah

If he had manhandled me like that, I would not pull a gun, but I would beat the sh_it out of him then have him charged with felony assault (truthfully, he probably would not have done that to a guy).

I do the same thing since I don't want some employee telling me to leave when I am shopping. All of the stores have a sign on their doors say wear a face diaper. I do not like it but I will comply.

There ya go... fixed it for you...

And you would won the fight, but lost the legal battle and ended up in jail, and with a nice civil damages suit in your lap. Next step, felon in possession. She pretty much sunk her case the second he asked her to leave and she refused, trespassing. Now she can argue unreasonable force in him manhandling her, but she's already starting form a damaged legal position. There will be no sympathy for her. She is further damaged by the mask mandate she refused to obey.

At the end of the day, private business tells you to get the hell out because they don't like you, you need to get scarce. You want to argue their right to do so, do it later.

My current M.O. is to wear my mask when entering an establishment. I read the room and unless I see someone itching for a confrontation, I pop one of the ears free and let it dangle off the other ear.

I have a full beard and 2 years worth of mullet to go with it.

The only people that hassle me are paid to do so, so I can live with that, for now.

Wrong, he started it, hence felony assault... and if you feel that way about things perhaps you should just give up on ever sticking up for yourself...
Never bow down to Stasi scum and do not advocate for others to do so, remember that's what they want... total and utter fear and obedience and the store clerk with his behavior is adhering to and is complicit with the wishes of our would-be tyrants...

Well, if you believe that, then surely her attorney will do so as well. Case records are public. We shall see... I predict a plea on her part because she has a very weak legal position.

It looks like we view things differently than others. Although I do not think that the amount of force he used would rise to a felony lever, he was clearly the original aggressor. So the question is whether her display of the firearm was excessive in light of just having been battered.
