The King County Prosecutor's Office will not seek a retrial in the assault case against Marc and Elizabeth Hokoana, accused in the near-fatal shooting of an anti-fascist protester on the University of Washington campus during a violent demonstration over the appearance of far-right firebrand Milo Yiannopoulos on Inauguration Day 2017.

A jury in King County Superior Court deadlocked in August after a five-week trial and five days of deliberations when the panel split over ideological lines, according to the jury foreman, and the shooting victim refused to testify.

Judge Kristen Richardson declared a mistrial and prosecutors have been weighing their chances on winning a unanimous verdict in a retrial. Whitney Keyes, a spokeswoman for King County Prosecuting Attorney Dan Satterberg, said Friday the decision was that a retrial likely would yield the same result.

"Our office has carefully reviewed the evidence produced at trial and considered whether a retrial would be likely to produce a different outcome. We believe it unlikely that a retrial would produce a unanimous verdict," Satterberg said in a statement. "In light of that, we have decided to dismiss this case."

Satterberg declined to comment further.

What a load of fertilizer. If you believe this biased article, the couple were out for blood. They exposed their social media but not the antifa member who was apparently just minding his own business and picked randomly from the crowd.

This push to allow masked individuals to attack you without defending yourselves is fueling more events to happen. Not saying this jack wagon was masked but this was a few years ago. They've learned.

People are free to attend whatever they want. Keep your hands off and you won't get shot. Pretty simple.

Seattle times clearly trying to demonize this couple and outright defend Antifa as if they are "peaceful".. I have no doubt the antifa member escalated the situation and attacked first. ST doesn't at ALL take a look or quote the antifa members social media page.. how convenient.

This is to be expected from a paper like this. Even if one of their own was attacked they would of course support the scum. This is after all Seattle. The way the entire event was set up they were begging for this to happen. The one real stupid thing the couple did, assuming this was not fiction, is go to social media and make it look like they were looking for a fight. Again though this is what the voters of Seattle keep saying they want, so this is what they get. I would not wade into some mess like that at gun point.
