In other news.... From our attorney... as of last night:

"[the appeal]....officially scheduled for September 18-22. There is a lot of work to be done between then and now.

The best news to come out of today [03/03/2024] is that the Defendants do not want a Preliminary Injunction hearing on the Permit to Purchase aspect of Measure 114. This means that ALL of Measure 114 will remain blocked until at least the conclusion of our trial."

Fantastic! I was thinking about placing an order for an item with a 16 week lead time but wasn't sure. Sounds like I'm good to order.
Funny- I had been looking at ordering a very high end Atlas Athena. They currently have a 6 month wait. So that would put me right at. . . . . September!!! Argh ;-)

It still costs a ton of money to handle the case. You can donate directly to the legal team via the Give Send Go Link. If you like, and if you want the tax deduction, you can also contribute through the Oregon Firearms Education Foundation. The education foundation is a 501(c3) organization. You can earmark your donation to go to the legal battle. The foundation has donated at least $10k so far.

They have lots of time to strategize....
What are the odds against us they will overturn Raschios ruling? What do they have to prove?

Based on Judge James Egan's concurrence against the Columbia County's 2A sanctuary ordinance... I think its all but a lost case, depending on who else on the Appeals bench are aligned with Oregon AG political views :rolleyes: although, it remains to be seen if Oregon Supremes are going to affirm for Oregon AG if Appeals overturn Raschio.

Edit as to "prove", they have a need to show to the anti2A donors and anti2A party that gun control can and still will be law of the Coast against SCOTUS, or else they lose their positions via "resignations due to scandals"

However, the Fed case might still work in our favor if 9th District follows SCOTUS. If not, there is still the Benitez (Bonta or Miller?) case coming to SCOTUS, maybe?

What Ive learned debating politics with my liberal friends is no matter what the law is, no matter what the state constitution is, no matter what the 2A says, no matter what the subject is... they will reword its meaning and definition to fit theirs.
I'm just left wondering if there is some practical limit to doing that game. Like when even an anti gun judge looks at the appeal mind game and says this doesnt fly.

What I find interesting is the state deciding not to pursue the stay hearing. I don't think it's any secret that a lot of judicial interference and collusion goes on behind closed doors and it has to make me wonder if the state was failing to get a pre-determined outcome commitment to step that far outside of the lines (aka "law") to do their bidding... so decided to drop it(?)

I mean... if they don't have the win already in their pocket before the case is even heard it would severely weakens their case if their petition was officially denied and made a matter of record.

The general sense across the nation seems to be a slight changing of the tide and that has to be giving some judges a moment of pause about how they've been getting away with freewheeling their way around the laws. There may be some accountability coming down the road and they certainly don't want any part of that.

Probably just wishful thinking... and pure speculation, anyway.

Bruen was a major slap to anti gunners. It basically gave the one or two conservative judges left in blue states a leg to stand on (Raschio and Benitez) so the left has to think wisely how to appeal these without causing it to go to SCOTUS where they know it will end their game. I think this is why Oregons supremes didnt reject Raschios ruling.

So it leaves me wondering what they are strategizing. Like I said they will rewrite definitions if they have to.
