Received an email on the new title with a couple of attachments.

New title:
Prohibits "assault weapons" (defined), "large capacity magazines" (defined), unless

It leaves out the "you can never buy a new one again" clause right? You wont be able to go buy a gun and register it

I didn't even get the email, and I've been on the list for quite some time. I wonder how many others it accidentally skipped. (No, I didn't accidentally delete it and it's not in my spam folder)

"Our usual practice is to individually
address each comment letter we received; it is not possible to do so here. However, many of the
comments presented the same themes or arguments, and we address those common concerns in
this letter."

then it goes on to say here is a summary of the comments we received

regarding the title itself, what a yes/no vote means, and the revisions they certify.

here is the wording that is certified for the title, yes/no vote and summary -

Title
Prohibits "Assault Weapons" (Defined), "Large Capacity Magazines" (Defined), Unless

Registered With State Police. Criminal Penalties.

Result of "Yes" Vote: "Yes" vote prohibits "assault weapons" (defined), "large
capacity magazines" (defined), unless registered with State Police after
background check. Criminal penalties. State Police must maintain registry.

Result of "No" Vote: "No" vote retains current law requiring
background check for firearm purchases, barring purchases by certain individuals,
and not requiring registration of firearms or ammunition magazines.

summary:
Summary: Measure prohibits "assault weapons" (defined), "large capacity magazines"
(defined), unless registered with State Police after background check. Criminal penalties.
"Assault weapons" definition includes:
 Semiautomatic rifles with detachable magazine and certain additional features;
 "Semiautomatic, centerfire or rimfire rifles," or semiautomatic pistol, capable of
holding more than ten bullets with fixed magazine;
 Semiautomatic centerfire rifles under thirty inches;
 Semiautomatic handguns with certain additional features;
 Semiautomatic shotguns with certain additional features;
 Shotguns with revolving cylinders.
"Large capacity magazines" defined as capable of holding over 10 rounds, excluding
tubular magazines in .22 caliber or lever-action firearms.
Covered items not registered must be sold/ surrendered/ destroyed. State Police must
maintain registry. Acquisition mostly prohibited after effective date, January 1, 2019.
Measure may limit uses of covered items. Other provisions

The "Definition" of "Assault Weapon" is hilariously vague even after they "revised" it. "Certain additional features"?? That could include literally anything.

Also, doesn't the proposed registry violate some Supreme Court decision or another?

It's my understanding that they (i believe it was the Sec of State office) that they could only address.. the title, yes/no, and summary. but the rest of the initiative remains in tact.

I believe this to be the definition of an AW in the IP 43 itself
  • any semiautomatic rifle with a detachable magazine and any of the following features:
    • a grip, such as a pistol grip or thumbhole stock, designed to allow the operators trigger hand to be directly below the action of the rifle while firing rather than behind the firing action of the rifle as with most traditional hunting rifles;
    • any grip or shroud that can be held by the non-trigger hand while firing;
    • a flash suppressor or muzzle break/compensator or reduce recoil;
    • a bayonet mount or grenade/flare launcher;
  • any semiautomatic pistol or rifle with a fixed ammunition magazine with a capacity of more than 10 rounds;
  • any semiautomatic rifle shorter than 30 inches;
  • a semiautomatic pistol with one of the following:
    • any secondary grip or barrel cover that can be held by the non-trigger hand while firing;
    • a folding, telescoping, or thumbhole stock;
    • the ability to accept an ammunition magazine in any other location than into the grip;
    • a threaded barrel that can accept a silencer;
  • any semiautomatic shotgun with any of the following features:
    • a pistol or thumbhole grip combined with a folding or telescoping stock;
    • a fixed ammunition magazine capable of holding more than 10 rounds;
    • an ability to receive a detachable ammunition magazine;
    • a revolving cylinder magazine
  • any kit or combination of parts able to convert a firearm in any of the ways prohibited above.

The title, results of Yes vote, results of No vote and Summary are just what appear on the ballot, it's not intended to be a full definition. That's included in the law itself.

It violates the Firearms Owners Protection Act of 1986

"No such rule or regulation prescribed [by the Attorney General] after the date of the enactment of the Firearms Owners Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or disposition be established. Nothing in this section expands or restricts the Secretary's authority to inquire into the disposition of any firearm in the course of a criminal investigation."

This actually means there are no exceptions.

Sure, but who is going to read the full text before voting? I guess it may not matter; Folks who are pro-2a will vote against and those with the gun-grabbing, reactionary, mentality will vote for. I suppose there won't really be that many people who are on the fence. :rolleyes:

So, has anyone tried taking the State to court over retaining firearm purchase (transaction) records for 5 years? Or was that in place prior to 1986?
