So now the progressives probably think that we will celebrate by going outside and shooting guns in the air. Sorry to disappoint them but we tend to be responsible gun owners and we stand proudly behind safe gun practices. Why don't they get that?

The Supreme Court sent it back to the AG to correct the misleading caption (Assault Weapon language).

Even if they did that today, we have 10 days to appeal (which has to pass before it can move forward).

A big thank you to all who filed comments and appeals, and especially to the OOC, NRA-ILA, and OFF. And a big part of this victory is the work of @LethalLovebird who spearheaded and organized a lot of the on-line and in-person communications. Great work Derek! I know you put in a lot of hours on this.

We cannot, however become complacent. We have won this round, but the fight is not over.

I could be wrong, but I think that only pertains to double-edged knives, daggers, etc.

OR's CHL covers handguns only, not batons, knives, tasers, or anything else. You're right that it should be changed to a CWP. There's a lot of ambiguity and confusion in the current statutes and court cases often get decided on precident versus the letter of the law.

No, the two relevant court cases involved lock blade single edge folding knives. So for a single edge lock blade knife, you can carry concealed up to a blade of a certain length which is at least 4 3/4 blade. All double edged knives are illegal to carry concealed in Oregon, whatever the blade length. And as best I can tell reading the law, all fix blade knives are illegal to carry concealed.

Even better news is that SCOTUS Justice Kennedy announced his retirement which means POTUS should be able to get a new justice onboard before the November elections, and assuming he follows in the path of Gorsuch and gets someone close to 50, we should have a 5-4 conservative majority for the next decade minimum. The oldest conservative justice on our side is Thomas at 70. They have Ginsberg at 85 and Breyer at 79.

"IP 43 IS DEAD!
This morning, June 27th the Oregon Supreme Court struck down Initiative Petition 43's misleading and political charged ballot title. The court's opinion agreed with the Oregon Outdoor Council's legal team, that the term "assault weapon" is politically charged and has varying definitions. As a result, the ballot title fails to meet the legal obligation to accurately define what the measure does.

In essence, the court agreed and referred IP 43 back to the Oregon Attorney General to be re-written. This move officially runs out the clock on IP 43.

Below is a short quote from the court's opinion.

"[P]etitioners argue that, if a commonly understood meaning of "assault weapons" exists, it refers to military-style weapons, not semiautomatic weapons with the types of features described in IP 43 (many of which, they contend, are "standard"). We cannot say whether that 170 Beyer v. Rosenblum is so, but we do agree (as does the Attorney General) that different voters reasonably could draw different meanings from the term "assault weapons"—some might think that it refers to only military-style weapons; some might think that it refers to the types of weapons that are described in IP 43; and some might think that it refers to an even more broad group of weapons."

"[G]iven the particular definitions set out in IP 43, section 3, we conclude that the caption could accurately state that the proposed measure would criminalize the possession and transfer of many semiautomatic weapons, as well as magazines holding over 10 rounds. We refer the caption to the Attorney General for modification."

I bet they put Ginsberg in a hyperbaric chamber hoping Trump won't get a second term. IMO since she believes the US Constitution is a poor one to use as an example for a new country she is not fit to be of it's highest custodians.

That is great news. Up until recently, there was argument over whether 2A even applied to individuals. Or protected a citizen's right to self defense. And some states maintain it didn't. Practically speaking, the Supreme Court is where gun rights play out ultimately.

It is OUTSTANDING news, not just for the Pro-2A crowd, but for the country as well. At least we will have one big firebreak to keep the country from sliding into socialism. I hope POTUS can do the same for all the circuit courts around the country as well. But if we lose control of the Senate and/or House in November, all bets are off.

At least there is nothing that should keep us from getting a 5 conservative justice before then

Out of state donations that negate the voices of OR residents.
Signature collectors should be licensed and undergo BGC. Made to wear ID tags.
Mandatory recording of ALL comments made by collectors---should be simple with today's electronic devices.

The main concept is the proposition procedure is intended to provide Oregon CITIZENS to initiate bills that have not been proposed or acted on by the seated legislature. The practice of non state citizens participating in the process by donations and actions that are intended to actually out number citizen action compromises the power of the true citizens of Oregon.

Am I the only one who's a tiny bit disappointed that I won't be able to catch and turn in a petitioner for falsification? It's kind of like getting a hunting season cancelled. :(

Add out of state chief petitioners to that. Great ideas to propose reform to our legislators and failing that our own initiative. Thank God Dennis Richardson is the SoS and we should all be praying for his continued good health in light of his recent medical condition.
