The Supreme Court sent it back to the AG to correct the misleading caption (Assault Weapon language).

Even if they did that today, we have 10 days to appeal (which has to pass before it can move forward).

We win, game over (for now). Formal post from OOC coming...
 
IP 43 & IP 44 may have gone down in smoke, but we still need to keep our momentum going. This is not the time to go back to sleep. We need to ensure that our legislators get the message that we aren't going to just stand there and take whatever heavy handed fantasies they have for the February session. If we pass that hurdle, the sponsors of these two petitions will be back in 2020 with lessons learned and likely fully fueled with Bloombux.

Great news! Thank you, OOC, OFF, NWFA, and everyone who collectively pitched in to fight and defend our freedom and The Constitution. We have been heard.

As others have mentioned, we cannot relent. Let this momentum carry to clean out the socialist agenda, and remove all those in Salem who oppose 2A.

They already knew 43 wouldn't have the time and were following through so they could get publicity and morally superior victim status. My bet is that they have already been preparing for 2020. They will likely wait a bit and file paperwork for a new 43 and 44 when they think we aren't watching. They will file early hoping we will vent some steam and go back to sleep.

Remember who did the heavy lifting for us (OOC, OFF, NRA - who else?) this time around and keep making contributions so they will be full armed when we need them, which could be as early as the February legislative session. Even 5 bux each pay period to one of them will add up quick and make a huge difference.

Any chance some one can post the courts actual ruling and instructions to the A.G?

Can we start a Recall of the comunist A.G.?
What about the O.S.C. can we unseat them as well, install a new and honest bench?
 
Heavy sigh of relief on my part. But they won't let this minor setback stop the movement as already noted above.

Vote the bums out. All incumbents at every level of government, regardless of party, need to be sent packing. Kate Brown and her ilk need to go. That's short term.

Next, repeal the 17th Amendment and institute term limits for Congress and SCOTUS. Not specific to our situation in Oregon but the entire ship of state needs to be repaired or this death spiral will continue.

"IP 43 IS DEAD!
This morning, June 27th the Oregon Supreme Court struck down Initiative Petition 43's misleading and political charged ballot title. The court's opinion agreed with the Oregon Outdoor Council's legal team, that the term "assault weapon" is politically charged and has varying definitions. As a result, the ballot title fails to meet the legal obligation to accurately define what the measure does.

In essence, the court agreed and referred IP 43 back to the Oregon Attorney General to be re-written. This move officially runs out the clock on IP 43.

Below is a short quote from the court's opinion.

"[P]etitioners argue that, if a commonly understood meaning of "assault weapons" exists, it refers to military-style weapons, not semiautomatic weapons with the types of features described in IP 43 (many of which, they contend, are "standard"). We cannot say whether that 170 Beyer v. Rosenblum is so, but we do agree (as does the Attorney General) that different voters reasonably could draw different meanings from the term "assault weapons"—some might think that it refers to only military-style weapons; some might think that it refers to the types of weapons that are described in IP 43; and some might think that it refers to an even more broad group of weapons."

"[G]iven the particular definitions set out in IP 43, section 3, we conclude that the caption could accurately state that the proposed measure would criminalize the possession and transfer of many semiautomatic weapons, as well as magazines holding over 10 rounds. We refer the caption to the Attorney General for modification."

According to the courts Ruling, the term "Assault weapon" is to broad and misleading, it can be used to describe only military issue weapons ( correct call Justices) and it can be misrepresented by the list of specific features That would ban non military weapons! The court also "Found" the term too broad and full of multiple meanings! Emotionally Charged!
