Yeah same, IP44 only passes the first phase for 1000 signatures to request a draft ballot title. Nothing on IP43. What happens if they fail to meet the deadline?

The Attorney General being the good lock step Democrat they are will extend the deadline so they can get whatever they need to get it named and on the ballot.
 
Yep not bagging on PERS people at all, just the system that got it to what it is. I did a few years in the system and my wife did 17 in Tier One. The retirees deserve what was promised them.

Sam seems to be the best bet for the conservative vote and hopefully gain at least the statehouse for the first time in 30 years. The wild card here is why the AG (Demorat) names the ballot measure.

Right off the top of my head, the phrase "with exeptions" (plural) is misleading, since there is only one exception, registration.

Also, transfer is criminalized without exception.

The Attorney General has released her proposed ballot title and summary for IP 43, the state-wide firearms confiscation measure.

You can read her title and summary here.

The short version is this:

DRAFT BALLOT TITLE Criminalizes possession or transfer of "assault weapons" (defined) or "large capacity magazines" (defined), with exceptions

As you can see, the ballot title falls far short of covering all the dangerous and onerous provisions of this measure.

Oregon voters can send comments about this ballot title to the Oregon Secretary of State for the next ten days. Keep in mind, your comments must be on the" ballot title " not on the absurd language of the ballot itself.

One thing the Secretary of State does not make clear, and this is important, is that they want all comments submitted to be "signed." So while you can print out your comments, sign them and scan them and send the scanned documents to the Secretary of State via email, a simple email with your comments will not work.

Here is the actual language of the ballot measure.

If you plan on submitting comments or suggested ballot title language,( and you should) please carefully read the measure and then submit your comments based on the obvious shortcomings of the ballot title. You will want to concentrate on why the ballot title language is insufficient, misleading, incorrect or inflammatory. If you provide comments you will have standing to challenge the ballot title language in the Oregon Supreme Court.

Clearly the simple use of the meaningless term "assault weapon" is misleading and inflammatory. The title also makes no mention of the fact that magazines will have to be "registered" something that is essentially not possible.

Suggested ballot titles may not exceed 15 words. (Yes, we know that's absurd.)

As you know, this measure is intended to do nothing less than make felons out of many thousands of Oregonians while making no one safer. We strongly encourage you to be involved and send you comments to the Secretary of State.
 
So here are a couple of alternative titles

Version 1 most similar to original

"Criminalizes unregistered possession, and all transfer, of "assault weapons" (defined) or large capacity magazines (defined)"

Version 2 more accurate

"Criminalizes unregistered possession, and all transfer of "semiautomatic weapons", or large capacity magazines (defined)"
 
Here's my email:

"Dear Ms. Rosenblum,

The Draft Ballot Title for IP 43 is misleading by omission and does not adequately sum up the full and far-reaching effects this Initiative Petition could have on hundreds of thousands of law-abiding Oregonians including hunters, hikers, off-duty law enforcement officers, women victimized by domestic violence, and vulnerable populations such as the elderly and mobility impaired. Particularly because of restrictions included in the initiative on how and where firearms that are currently owned can be used, a more accurate title would read 'Criminalizes possession of most semi-automatic handguns, rifles, shotguns, and their magazines; exceptions'.

A voter should not have to read the definition of 'assault weapon', which is quite lengthy in this initiative, in order to understand what this initiative would do; this should be self-evident in the title and 15 words is adequate to accomplish that as I have shown above.

Thank you for your consideration,"

Good analogy. PERS employees have a sweet deal no doubt. Any attempt to break those union contracts would go to state court which of course is staffed by judges who are in the PERS system themselves. Only a catastrophic collapse of the PERS system which will occur after a collapse of the state government finance system as they try to keep the PERS system solvent, unless of course they can tax the people enough to plug the hole.

As far as Social Security, we all know that is controlled by the Federal government which can do anything they want to. Complete class control by those Federal workers.

The proposed caption for Initiative Petition 2018-043, proposed for the November 6, 2018, General Election does not meet the requirements of the Oregon State Constitution which requires that initiative measures address only one subject:

"Article IV, Section 1(d):

An initiative petition shall include the full text of the proposed law or amendment to the Constitution. A proposed law or amendment to the Constitution shall embrace one subject only and matters properly connected therewith"

Initiative Petition 2018-043 addresses two separate subjects, those being the possession of a certain class of firearms, and the possession of a certain class of firearm magazines which may or may not be applicable to the aforementioned class of firearms, and may be relevant to an entirely different class of firearms. If an elector desires to approve only one subject or the other he or she must approve both.


Further, Initiative Petition 2018-043 violates ORS 250.035:

(2)The ballot title of any state measure to be initiated or referred shall consist of:

(a)A caption of not more than 15 words that reasonably identifies the subject matter of the state measure. The caption of an initiative or referendum amendment to the Constitution shall begin with the phrase, "Amends Constitution," which shall not be counted for purposes of the 15-word caption limit;


Initiative Petition 2018-043 uses the ambiguous and emotionally charged term "assault weapon". While the full text of the measure goes on to define what petitioners believe constitutes an "assault weapon", the general public has been indoctrinated to believe that "assault weapons", whatever they might actually be, are intrinsically evil. There are numerous definitions of the term "assault weapon" that have been routinely explained in the media, in previous legislation, and in public debate for decades. These definitions vary wildly in their scope and meaning, and the design features covered. The use of the term "assault weapons" in this ballot caption is misleading and plays upon the emotional responses of the voters.


For these reasons, the proposed ballot caption for Initiative Petition 2018-043 should be rejected and revised.

Please if anyone is going to a rally against 43/44 please leave the hardware home. The media will be looking for opportunity to scare their viewers with you hardware; please dress as if you are going to church. Thanks for thinking about this.

The other night I was at a 43 educational seminar and a son of a holocaust survivor came up to me and said he was armed and "Never again". I asked him if there were holocaust survivors in Pdx and there were, but avoid politics and too old. I amazes me that black people might advocate for gun control but their history was that slave owners had the guns and they were killed if they were arm until the NRA promoted their gun rights!

People of color don't like that hippie BS. They like football and BBQ like the rest of us. And many of them proudly identify as Christians. They want the America they were promised, not some kind of socialist utopia. To me the proof is in all those majority African American counties in the Upper Midwest who supported Obama that also voted for Donald Trump. All people, including all minorities, are harmed by uncontrolled migration supported by the D (communist) party. Many minorities own guns and are not interested in Hillary style gun control - this is, confiscation.

I like the cut of your jib! But I'd go in a slightly different direction:

IP43 has FOUR subjects, not just two.

1) Bans a whole host of semi-automatic weapons.
2) Bans magazines larger than 10.
3) Criminalizes (w/ exceptions) past possession of those same semi-automatic weapons.
4) Criminalizes (w/ exceptions) past possession of those same magazines.

No matter how you cut it though, this is a violation Article IV, Section 1(d) and (I'd argue) Article I, Section 21:

No ex-post facto law, or law impairing the obligation of contracts shall ever be passed, nor shall any law be passed, the taking effect of which shall be made to depend upon any authority, except as provided in this Constitution; provided, that laws locating the Capitol of the State, locating County Seats, and submitting town, and corporate acts, and other local, and Special laws may take effect, or not, upon a vote of the electors interested.—
