I will be out on the Johnson Creek Blvd overpass by noon today and will hang out with signs for a couple of hours. I will be giving out 5 tickets to those who want to volunteer to help out holding a sign. Sportsman's is nearby which would also be a good spot to hold signs. PM me by 11am if you would like to help out with sign holding today.

@elija_t and @ob1 came out to help me again today on the Johnson Creek Blvd overpass. It was great day with lots of positive responses. There were some middle fingers thrown at us but not nearly as many as we got yesterday from Nyberg overpass. Weather was decent. Thanks again to @elija_t and @ob1 for stepping up two days in a row.

I will be hitting I5 again tomorrow morning on the Boeckman Rd overpass in Wilsonville. I will be displaying the signs to Northbound traffic which usually runs pretty slow in the morning.

Take an umbrella and maybe something hot to drink. At least you are trying to do something. If I lived down there I would bring you lunch and something to warm you up for the work you're putting in on this.
Appreciate that but it's close to home so I will throw on the rain gear and grin and bear it for an hour or so. Maybe the rain will slow the traffic down. Off to the gym now to get in a quick workout before suiting up to hit the overpass.

I got a little over an hour in before an ODOT emergency crew member chased me off the overpass. She said it's prohibited to display signs from an overpass. I thought it was permitted but I can't find the relevant statute. If anybody else knows what the statute number is please advise.

I STRONGLY suspect it depends entirely on what sign you want to stand there with.

That's possible. There maybe be a 1st Amendment conflict if she is wrong about what the statutes say about displaying signs.

Here is one statute that deals with signs. I am not sure the vote no on measure 114 would be prohibited under this statute?

I sent the ODOT director an email this morning to see if he can straighten this out. I am not holding my breath that I will hear from him anytime soon.

Amazingly I received a quick response from ODOT. This makes me think it is OK to hold the sign on the overpass as long as it is not attached? I replied asking for clarification of that.

"Only official traffic control signs and devices are allowed on state highway right-of-way (see OAR 734-020-0005). When the ODOT crew member arrived they observed the sign was attached to the fence with clips. They advised you could not have the sign attached to the structure.
ODOT does not require permits for sign or flag waving. Participants may not impede traffic and must keep sidewalks clear. We do not allow signs or flags on our right-of-way so these items must be held and not hung or affixed to ODOT structures."

This is the clarification I received:

"I apologize for any confusion and have shared your email with the ODOT district manager.
My understanding is you may hold the sign on the overpass (not attached to or dangling over the structure). You must also not impede traffic and must keep sidewalks clear. You are welcome to speak to an ODOT permit specialist at 971-673-6200. Though a permit is not required, they can go over any further questions you may have."



From here on out I will not attach the sign to any part of the overpass and will simply hold it. I can see a sign nazi ODOT worker hassling me for impeding the sidewalk. They don't seem to have a problem with bums, junkies and homeless impeding sidewalks.
 
I'd still attach them if necessary, out of a concern for safety if there is a chance for it to fall onto traffic below. I believe the rule has more to do with people attaching signs and leaving them unattended. As long as you have your hands on it, it should be fine!
