Sadly a LOT of people who "should" know better choose to either not vote at all , saying there is not point, or they throw away their vote because the "better choice" is bellow them and they will not support them. So they write in some protest vote. Telling themselves they are better. Sounds great but then we get jay and next sideshow. Remember this state could not get enough gun owners to sign the petition to put it back to a vote so my Ruger 10/22 would not be an assault weapon. We could not even get that. Has nothing to do with how many people are in Seattle when gun owners can not be bothered. Just not enough pain felt yet.

My guess is because a criminal lawsuit has the potential to go all the way to the Supreme court.
Because selling so-called "high capacity magazines" is a violation of the consumer protection law, not a criminal violation, so a civil lawsuit is the only avenue the state has. There are still stiff penalties though ($7500 per sale or offer to sale).
I should think PLCAA should have some bearing here, too. Get some of that sweet Federal "Deprivation of Rights Under Color of Law" action going... FAT punitives on that one.

I cannot control who they hire to represent them. Imo we have to learn to use those lawyers who are successful and not waste our limited financial resources on lawyers who are ineffective. Good question. Not knowing anything about the guy I could only hazard a guess. Ever met any of the "Sovereign Citizen" types? There is a bunch of them running around who often go off the deep end. Had a friend who did. Some of these guys start reading too much "law info" and start to really believe they can win fights like this. Often they get to a point where there is just no reaching them anymore. I have to "guess" this poor guy falls in this spectrum somewhere. I would have to guess he really thinks he can win this fight or he would not have done this. Sadly he will NOT win. He will lose and if he pushes it far enough he will lose everything he has worked for. Yes the law is STUPID but, the AG here has basically unlimited money to go after this guy and he will not care what it costs.
