Machinegun

26 U.S.C. § 5845(b)

For the purposes of the National Firearms Act the term Machinegun means:

  • Any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot without manual reloading, by a single function of the trigger
  • The frame or receiver of any such weapon
  • Any part designed and intended solely and exclusively or combination of parts designed and intended for use in converting a weapon into a machinegun, or
  • Any combination of parts from which a machinegun can be assembled if such parts are in the possession or under the control of a person.

The definition of "machinegun" from the ATF site as they discussed the bump stock:


..bump stocks fall within the definition of "machinegun" under federal law, as such devices allow a shooter of a semiautomatic firearm to initiate a continuous firing cycle with a single pull of the trigger.

How does this not "allow a shooter of a semiautomatic firearm to initiate a continuous firing cycle with a single pull of the trigger?

OK. So would the ATF arrest someone for using a bump stock? Their official statement at the same link I gave above ordered everyone to destroy them or turn them in to ATF.

Thats not what a happened with the akins accelerator. He submitted what was essentially a bumpstock and then changed the production version to include a spring that made the stock set function as a machinegun.
 
Well damn, that's what I get for reading his account instead of the digging in
There was more too. Apparently the sample he sent in was broken anyway and was set up for an sks. The ATF couldn't get it to work and sent a letter back saying no, it was not a machine gun (duh). When it went to production it was built for a 10/22 and was fully functional with a spring that pulled the rifle action forward. It was the textbook example of how not to run a business.

Caveat: In some (most??? o_O ) states.
The Trump EO that banned them was overruled by the 6th Circuit Court of Appeals and Gun Owners of America (plaintiff) was award a preliminary injunction from the rule being enforced.

That being said, that anti-2A phuq'r Sideshow Bob Ferguson "requested" that anti-2A Leftists in Olympia support a bill (HB 1739) that he wrote as AG (abuse of power) that made them illegal, which passed the WA State Legislature in the 2019 regular session.

So in WA, "...it is unlawful for any person to manufacture, own, buy, sell, loan, furnish, transport, or have in possession or under control, any... ...bump-fire stock..." :mad: 🤬 :mad:🤬:mad:🤬:mad:🤬:mad:🤬🤬🤬🤬🤬🤬🤬

Thank you for the clarification. I was referring to Federally, not State. Federally there's no mag capacity bans, but States... well. You know that several states have such bans
