I guess your only chance would be to dispatch the shooter, if you were in a position to do so, then holster or put your gun on the ground and raise your hands quickly and identify yourself. Maybe get a witness to support your position, even before you act.

Most of us with our little wussy P3AT 380's would hide behind a big post, with our knees knocking like Don Knotts in the movie, "The Ghost and Mr. Chicken!"
