In an incident that is being repeated all across the country far more frequently than is reported, a retired Navy veteran in Glendale, Arizona, has had his gun collection confiscated by authorities after an irate neighbor filed a harassment order.

Rick Bailey, 56, is a disabled retired software-systems engineer who has slowly accrued a collection of 28 firearms, with an estimated worth of about $25,000. The collection was seized after a neighbor claimed Bailey threatened to shoot him, an accusation Bailey calls "bullsh-t."

The dispute between the neighbors started several months ago regarding dump trucks used in a landscaping business. Bailey said his neighbor would park two "large, smelly" dump trucks in the small cul-de-sac where they reside.

Eventually, Bailey filed a complaint with the city to remove the dump trucks and other work-related vehicles from the private residential area. Although initially the neighbor complied, Bailey said he would sometimes bring the dump trucks back on weekends when the city was closed, "just to irritate us."

The situation climaxed on March 16 after Bailey called police because he smelled what he thought were "toxic chemicals" coming from the neighbor's property. "I spend my days sitting out on my patio relaxing," Bailey said in an interview with the Blaze. "The smell got so bad, I had to come back to my patio and use my inhaler – so I called the police to see if anything could be done."

When the police arrived, Bailey said he was told by police officers that the neighbor alleged he had threatened to "shoot" him, a claim Bailey says is false. The next day, March 17, the neighbor told authorities that Bailey had threatened him and filed for an "injunction against harassment."

Bailey denies threatening his neighbor, and says his physical disability renders him incapable of harming the man. He said he fully understands the implications of threatening to "shoot" someone, even as a joke, and says he made no such threat.

A judge not only issued a protective order to the neighbor, but also issued a separate order to confiscate Bailey's collection and revoke his right to purchase firearms.

The Second Amendment Foundation announced Tuesday it has taken on the funding of Bailey's case and is working to get his firearms collection returned.

"We seem to live in an environment when someone's life can be turned upside-down on an allegation that should have been thoroughly investigated before any action was ordered by a court," said SAF Founder and Executive Vice President Alan Gottlieb. "Sadly, this kind of hideous gun confiscation flies below the radar and it is happening more frequently to gun owners across the country."

Hope the lowlife neighbor gets hit with filing a false police report and has to pay the court costs and attorney fees used to straighten out the mess he caused.
 
Tis a sad commentary indeed. But I know it's true.

Guilty until proven innocent! That is - if you can afford the legal fees.

Also, I wonder about how I would feel about the cops handling my expensive rifles? Would they show respect to my Nightforce scopes? And custom show and competition pieces? Or are they gonna just toss um into an evidence locker? I would worry about my babies.

And let us not forget that feeling of having armed LEO's entering into my home and treating me like a criminal in front of friends and family as they confiscate my property on nothing more than an allegation.

This idea has me concerned not just for everyone but for mysf as well.

I have estranged baby momma who is about to receive custody paperwork and I'm hoping that she doesn't make some WAS (wild bubblegum statement) saying I threatened her in any way. She is aware I carry and is aware I have one or more firearms. While we will be ignoring her on all accounts I sure don't want that assumption to lead to me having to prove my innocence.

I bet it happens more than we know.

Yep the innocent until proven guilty has gone by the wayside and much of that is the LE's fault but most lies on the backs of the leftist legislators that are trying to take your guns. The Constitution means nothing to them anymore. There are good LE like the ones that came foreward against the UBC bs, but there are too many that have no respect for the Constitution and BoR anymore because they were raised in the current education system that is mostly communist/Marxist/socialist controlled.. They don't even know any better. Its been burned into their brains.
 
They have been taught that men are basically good, and inanimate objects are easy to blame for evil, because if guns make men evil they can hold on to their illusions that people are basically good, and I think they really believe that if they got rid of all guns we would live in a paradise on earth.

I have to disagree with the above quoted sentence; I believe that the LEO's that have no respect for the Constitution and BoR, do know better. They choose the anti stance, because once they pin on the badge, they believe that they are miles above us peasants, untouchable and part of the ruling class.

Yeah, no chance of lying from that guy...
 
Bailey (Inhaler guy)is the guy the guns were stolen from, and I agree he should have found some other way rather than starting a fight against someone trying to earn a living with his trucks, but the fact remains that the worse crime is that of police stealing his weapons.

I suspect that had he known his rights would be violated he would have found a way to work it out in a friendly way.
And I think getting past the anger and breaking through into turning your enemies into friends is a valuable art form.
 
If I had some guy parking dump trucks that smelled like bubblegum in the cul-de-sac I live in and I tried talking to him about it civilly but he did nothing I would be upset to. What other option would a guy have besides for calling the police nowadays? I know the guy has to make a living but come on I should not have to look at or smell his crap at my house. Personally I would have got him to move the stuff one way or the other but a disabled guy does not have many options, they say that you are supposed to just call the police and they will save you but we see what that got this guy.:confused:
 
Hard for me to understand, I live across the highway from a very large dairy. I absolutely hate the notion that some neighborhood commission or whatever they are called can force someone to paint their house a certain color or not park their pickup truck in their own driveway.
I've always managed to make peace with my neighbors, it just takes trying to see their side and talking it over so they can see yours.

Well, I can tell you I won't be there at your home taking your firearms, short a court order.

In fact, any of the ones in the larger of the two safes present in my home have state transfer forms, for which submitting them to the state was voluntary before Dec. 4th, which show they belong to my wife and son. Completed with dates AND signatures.

About to sell all my firearms to my cousin for a discounted price and setup my safe in his garage until everything blows over.....

I learned the painful lesson long ago, that a bad neighbor can make my life so difficult that the only legal option is to relocate. This applies to my home as well as my business!
