You want the police to investigate to the max and get it airtight as possible. You plug someone, you want it 110% justified as the wounded or deceased persons family can come at you tooth and nail, and they possibly will?
If their attorney's can nitpick something the investigation missed or failed to follow through on you and law inforcement are going to have some possible unplanned for legal problems.

Years ago we had a family member shoot and wound a parole violating felon in a home invasion. The guy was sent back to prison and the clown sued him while still in prison. He claimed he was disabled due to the shooting, and he actually was.

$75,000.00 settlement plus $$$$ for lawyers.

I don't doubt that the police will take a gun after a self-defence shoot.

But you stated that the shooter "is not under criminal investigation".

My point is this: If there is not a criminal investigation, then why do the police need to take any "evidence"?

The fact that the man is not under criminal investigation does not mean that there is no investigation taking place. Any time someone is shot, there is an investigation to determine what happened. The firearm is a piece of important evidence. They have to investigate the event, whether the shooter is under investigation or not.
