My understanding is judge Raschio has blocked 114 until he says otherwise because Oregon Supreme Court didn't want to touch it. So, 114 isn't in affect.

I'm not a lawyer, FFL and I didn't stay in a Holiday inn.

Yeah same, I mean at the end of the day I would trust Brownell's legal team to know lol

114 was the highest voted upon BM out of all 4 options for Oregon 2022.
 
This is where I am confused, I know the permit process is suspended right now but I didn't know if the mag caps were or not. Even my FFL was asking if he could toss/keep the mag that comes with my transfer
Short answer:
We'll know more about the magazines tomorrow afternoon, Fri, Dec 16!!

Long answer:
In the Harney County hearing on Tues, Dec 13, Judge Raschio put a TRO (temporary restraining order) in place for sections 1-10 (permitting and 3-day release sections) of BM114.
TRO for permitting will remain in effect until state can show the permitting process is 100% functional and ready for implementation. This could be months away.
Once the state feels they're ready, they'll notify Judge Raschio. Within 10 days of receiving that notice, Judge Raschio will hold another hearing to beat up the merits/constitutionality of this portion of BM114.

State did NOT like that sections 6-9 (sections concerning the 3-day release) were included in this potentially long term TRO.
State requested a separate hearing ASAP to argue removing sections 6-9 from the TRO.
This hearing is set for Fri, Dec 23.

Section 11 of BM114 covers the 10+ round magazine ban.
The bulk of hearing on Tues, Dec 13, was the judge hearing arguments on this topic.
State attorney has until noon on Fri, Dec 16, to submit everything for the record.

Judge Raschio will be issuing an opinion letter tomorrow afternoon, Fri, Dec 16.
This will let us know what's going to happen with section 11 (mag ban) of BM114.

Until that time, all parts of BM114 are still under TRO (not law).

Today a Judge in Harney County issued a preliminary injunction against the magazine ban in Measure 114.

In a previous hearing on Dec 13th the court put a hold on the "permit to purchase" portion of the bill and promised a ruling on the mag ban by tomorrow, Dec 16th.

The ruling came today and means that for now, your standard capacity magazines are safe.

There will still have to be a complete trial on the constitutionality of the measure, but at the moment the permit to purchase and the ban on standard magazines will not be allowed to go into effect.

The Court has granted a hearing on December 23 for the state to explain why the safeguard which allows the transfer of a firearm after three business days (if the Oregon State Police do not complete a background check or issue a denial) should be removed.

Considering the vast number of people who are currently being denied the ability to take possession of the firearms they have paid for, (as a result of the OSP's inaction on background checks) this should be a tough hill to climb for the state lawyers.

The battle continues both in this statewide case that Gun Owners of America has brought and the four other cases that are in Federal Court. But this is more good news and another win for GOA

Imagine, had to go to Harney County to be able to uphold the Oregon Constitution…. This is awesome news, hoping and praying for a similar response to next weeks hearings on eliminating the three day background check safety valve…
 
I went back and watched it. Pretty pitiful on the anti side. Avoid every question with rhetoric and "if it saves one, how much is that life worth"... while referencing uvalde and the like. No salient response to any question put to him.

On the pro2A side, he was very succint and logicaly presented the issues, facts and shortcomings.

IOW, same ol same ol from the left.

One comment really did piss me off though. The question was put, basically, as... isn't our childrens lives worth the delay measure 114 might cause for those who want to purchase a gun. Part of pro2A's response was that it's not tyically the law abiding affected by this measure that are involved in these mass shootings, and THEN.... anti2A throws out, statistics would prove otherwise to that response.

Crats mantra... if you want to make your point... LIE!!

How can i post this specific section on FB?
I dunno how FB works, but it might make it more manageable to put the list into a .pdf file. That way you can upload it once to a file share server and just post links to it for those interested to view and download as they like.

I'm not entirely computer savy though so maybe someone else has a better suggestion.

Or maybe just fax it to FB and they can post it?
 
Seems PSA fixed the block on certain mags. Those APX mags went thru for me now.

If you get a magazine brand that won't process email the PSA team and link to the specific product so they can fix it.
