I find it extremely unlikely that any FFL actually WOULD. Even in this circumstance.
I was told today that due to the fact that the state is actually marking the files as delayed, they are more inclined to release firearms under those circumstances.

I never understood why the need for a redundant background check system. That's part of the issue. First time buyer should go through the process completely.

If you already own multiple firearms it should do a surface level NCIC check and give a instant approval. Or alternatively give you an exemption and you walk out with the firearm in hand. My rationale is.. You already own multiple firearms, its not going to make a difference if you obtain another.

Even if you got a domestic violence or restraining order, courts usually have the Sheriff serve you a notice to relinquish them to the nearest agency within 24 hours or face more charges.

The redundant background process of constantly treating each sale as a new buyer is what is contributing to a 10k backlog

It is not the OSP that is a concern.

1) Customer fills out 4473.

2) Data is sent to OSP for BGC.

3) Approval is not forthcoming, but neither is delay or denial.

4) Licensee releases firearm to customer.

5) Notice of denial is received by the FFL from OSP one week after release of firearm.

6) Licensee gets to explain to ATF agents on site how he supplied a firearm to a prohibited person.

Just because one can do a thing does not mean that he should do a thing.
Or, maybe the customer was trying to purchase a firearm because they're being stocked and fear for their safety:

5) Approval comes back, but it's too late. Customer was murdered because they were denied their constitutional right to protect themselves.


The 72-hour rule exists to prevent background checks being used as back door gun bans. How long as it been now where Oregonians who don't have CHL are having to wait weeks? A delayed right is a denied right. I bet if a few more FFL's followed the law OSP would figure it out, or at least admit they're a pointless middle man in the process and get out of the way. 99.9% of FFL's aren't going to make the transfer no matter how ling it takes to get that approval and OSP knows it which is why it has been years now and the problem with all of these delays hasn't gotten any better.

Has anyone done a FFL to FFL stock transfer lately ?

Transfering existing stock (collectors item) ...from FFL A to FFL B, where the item will be sold and transferred to the buyer ?
 
Good to know we have some options seems like the FFL's here are throwing in the towel a lot will probably go out of business while waiting for a permit plan !
of course they are, when they are being treaded on they fold up. All BS posturing. When it comes down to it no one does anything and just bends the knee.

They'll do online sales only. Reduce staffing. Oregon will join the list of states on GB that people will not do business with. Along with all the major online firearms businesses. The pink and green hairs will be dancing with glee in the streets, they're safe now and have protected "the children" ... dirtbag career criminals are rubbing their hands together.

I think I've lived too long.

The Oregon State Police (OSP) is aware that the public has many questions regarding Ballot Measure 114. The Oregon Secretary of State's office notified OSP that Ballot Measure 114 will go into effect at 12:00 a.m. on December 8, 2022. The Oregon State Police is working very closely with the Department of Justice, the Oregon State Sheriffs' Association and the Oregon Association Chiefs of Police to assess the required processes that need to be completed to implement this law.
For the month of November 2022, approximately 63% of the requests received into the OSP Firearms Instant Check System (FICS) unit have been approved. The remaining transactions must be evaluated by an OSP employee to determine what caused the person to be kicked out of the automated process. If applicable a manual correction can be made, and the application can be approved.
Here are some important notes to consider when submitting for a Firearms purchase or transfer that could exclude you from the automated process:
  • If you have ever been arrested or convicted of a crime in Oregon or any other state.
  • If you have incomplete or incorrect information listed on federal ATF Form 4473
    • Potential Fix- Double-check the information for accuracy.
  • If your registered DMV address does not match the address listed on federal ATF Form 4473
    • Potential Fix- Update your personal address with DMV.
This unit has been working through these extreme firearms request volumes and will continue to process them as quickly as possible.
The FICS unit's hours of operation is set in Oregon Revised Statute (ORS), and largely determined by retail hours. FICS is open and processing background checks from 8:00 a.m. to 10:00 p.m., seven days a week 363 days a year with only Thanksgiving Day and Christmas Day off.
