So a punk arse drunk swiped the back corner of my wife's car as he pulled in and parked next to us. We were parked in front of the liquor store, getting ready to order a $10 Domino's pizza which is next door to the liquor store, when this occurred. I confronted the driver and told him he just swiped our car. He claimed to not have insurance or his driver's license on him. He offered to pay me some cash (which I should have took) but he wreaked of alcohol. So I told the bride to call 911. He stuck around and the cops actually showed up pretty quickly (try that in Portland). He magically found his driver's license when the cops showed up. They did a sobriety check on the guy and he passed so they filled out information exchange forms gave us each copies and went back to their cars.

I was no longer hungry for pizza, so we headed out. The other driver who was originally headed towards the liquor store decided to go over to the ice cream shop instead.

Anyways the damage to my wife's car is minimal and will mostly buff out, maybe require a spot of touch up paint. I saw no damage on the other guy's car.

After that blah, blah, blah back story my question is do I have to fill out a Oregon Traffic Collision And Insurance Report. The cop told us we have to fill one out within 72hrs. I looked over the form and it says I only need to fill it out if any one of the following conditions exist (See blue box in photo).

My wife is paranoid and says the cop said I had to fill out the form within 72hrs. The cops did not write an accident report because the damage did not warrant it.

I say the damage is nowhere near $2500 worth and I shouldn't have to fill out a report. The other guy had no damage that any of us could find on his rig. Nobody died or was injured.

Insurance will screw you any possible way.

And , iirc , your dumma$$ city will send you a ticket for failure to fill out report. Regardless of who is at fault. ( might be incorrect about the last part, but why risk it?)

We have no plans to make a claim on insurance. My fear is that if I fill out the report the insurance companies will use it as justification for jacking up my rates. I am accident free besides this ridiculousness.

Maybe you're good not being in Portland.

City of Portland actually suspended my adult child's license for not filling out that form. Sent notification via snail mail. It was reinstated quickly, but still a stupid process.

How much damage was involved? Did either driver file a claim? Did police file an accident report?

Much more damage.
Police refused to stay at scene after it was determined that no injuries involved.
Downtown Portland.
All parties filed claims .

They told us that they were not filling out an accident report because the damage did not warrant it.
 
More trouble than its is worth to take to the shop. Yeah, should have taken the cash. Oh well hindsight is 20/20. If he has a local insurance agent, sometimes they will just cut you a check rather than mess with a claim.

We aren't going to bother fixing it. I bet shopping carts have done more damage than happened to her car today.

NOW...One time years ago I had a minor parking lot accident, other driver and I agreed not enough damage to worry about. But he filed an accident report anyway, trying to do the legal thing. Which then triggered on my license (and a nasty letter) because I hadn't filed one within 72 hours.

That said, I would take my chances vs filing the report unless it was legally clear I was required to.
 
I believe the parameters for filing a report are:

-Pedestrian strike.

-Bodily injury / death.

-Cost of damage.

-Police involvement (witnessed or responded).

Based on the parameters stated, you do not need to fill one out.

I got hit by a 16yr old driver a few years ago. The kid had only held his license for two weeks before he pulled into the intersection I was passing thru (I had the green light) and hit the rear wheel of my truck. It chipped the rim and bent the tailpipe on my Ford, but the front facia got ripped off of his Prius.
Now, here's the stupid part; After we exchanged information I contacted his Dad. I offered to not fill out an accident report because the damage to my truck was minor and this kid's insurance would likely go thru the roof. His dad was very emphatic, "We HAVE to turn it in to the insurance'". No problem, Pops. It's not me who is "gonna pay".
The insurance company gave me over twice what I would have settled for. I wonder what that kids insurance cost the next payment cycle? :eek:

@arakboss , show your wife the state requirements again. If you can't check one of them as a "yes", then there is no legal reason to file.
 
The "potland factor" Good thing he's not here! Couldn't trust them.

I didn't realize the front plate of my old work truck was gone.....Until I received the parking ticket in the mail. The ticket issued to a blue 1969 Chevy 3/4 ton in downtown potland. There were pictures of the truck violating/getting ticket for no front plate. Was told I needed to send the fine in with proof it was not my YELLOW/GOLD '69 chevy. My pics had my truck and rear plate. They KEPT MY MONEY ANYWAY.

I had an accident a little over a year ago and the damage to either car did not appear to be severe enough to fill out a report.

I did not file a report.

We did exchange info and I notified my insurance co. (Allstate). She filed a claim with her insurance and my insurance paid off. Nobody's insurance screwed anybody and since Allstate has a "forgiveness" feature my insurance did not increase (I think they have that because they charge about double what Farmer's does).

Short story - no issues.
