My question still is if 4150 is vetoed and with the OSC in agreement with M114 then the measure would be law soon at that point .... or am I missing some info here ?

NOW – if HB 4145 fails, we're no worse off than we were going into the session. We will have an Oregon Supreme Court result in the coming months (expected August-November). If HB 4145 passes, we will still get that Oregon Supreme Court result, plus Ballot Measure 114 will be on hold until January 1, 2028. This gives us time to launch a repeal ballot measure, for SCOTUS to potentially rule on Duncan v. Bonta or Gator's Custom Guns, and time for the federal Ballot Measure 114 cases to see their case proceed to the 9th circuit

If she has not signed it and it has not yet been 30 days, then *is* it law?

This *is* important to me since I carry a lethal weapon (with a license) and I do want to comply with the laws surrounding that act, even the laws that I oppose.

Edit to add: Nope, not law yet, according to this:

It's enjoined by the court it CANNOT go into effect until the Oregon Supreme Court makes a ruling in favor of the law. March doesn't mean anything because they have not made a ruling. It's that simple
 
It would play out for the State Supreme Court to rule for M114 in 30 days and Gov to veto 4150 or vis versa , immediately to put it in effect ....

I can't see Gov signing 4150 and wait for OSC to agree with M114 .

They don't want this delayed .......
 
I don't know if there is a law that prevents the Governor from communicating with the OSC ...... If there isn't I see NO reason she wouldn't be talking to the court about matters such as this .

PS: Article III of the Oregon Constitution mandates separate executive and judicial branches, preventing one from exercising functions of the other, ensuring a system of checks and balances.

Is there anything that prohibits of communication between the two branches on legislation or litigation ........

I wonder how that actually works. I think it's more about the arresting officers and the DA. The sheriff sets the tone, but if Barney Fife chooses to arrest and the DA decides to charge, you are on the hook for what ever the law says.
 
Yes that's correct. that's unlikely. But in that specific series of events yes it would be in effect after the ruling
It would be in effect after the implementation is hashed out based on the findings of the court so even if OSSC ruled in favor and Kotek vetoed 4145 tommorow it's still likey 6 months or more from being implemented. The mag ban could go into effect immediately, but I think that's still enjoined at the federal level.
 
Why do people on here go out of there way to come up with a specific series of events that works out in the negative. This law was supposed to go in effect on Jan 1 2023. It's been over 3 years and it still is not in effect. Everytime there is a hearing or house committee or Tina kotek farts everyone on here acts as if the sky is falling. How many times have people on here acted as if it was going into effect because there was a hearing date and rushed to the store and bought a bunch of mags. Only for it to mean absolutely nothing and the court case just drug on and on. Have we still not learned that the courts move slow as hell? Nothing happens quick. If there was this massive conspiracy to pass this law specifically and the governor is in the osc's ear then why haven't they ruled yet? Why isn't it the law right now?
Nope it was all part of the plan tomorrow morning it will be the law and they're gonna come to your house and take your guns, shoot your dog, make your son gay and give you a sex change. There's no hope it's all lost.
 
I will admit ( happily) that I was wrong!!

I felt very confident that when this went to the OSC, that they would make/time their ruling right before the original Measure 114 date was to take effect (March 15). That of course was before HB 4145 existed, which if signed would postpone that date until 2028.

So now we wait to see when and what the OSC ruling will be, which as mentioned earlier could be any day, or a long ways off. Also see if gov signs 4145. Could there still be a conspiracy to have her not sign and have OSC rule quickly- yes, but guessing now pretty remote chance.

Everyone enjoy this additional time buying and stocking up on mags and guns!! ;-)

Hope for best (OSC rules it unconstitutional to Oregon Constitution),; but plan for the worst (OSC rules it good to go, Kotek vetoes 4145, OSC declares m114 go into to effect immediately, SCOTUS deny cert on Duncan V Bonta or GVR it again)

There's no conspiracy theory or sky is falling. People are reacting to laws going into effect. The conversation is based on the same reason people lock their doors even though no one has tried to open it a 3am. That is reality. We are happy the law has been postponed but it is still there until it legally is not.
