The judges had some pretty good qustions for both sides. Trying to not get my hopes up, but I saw hope for either direction. Of course my hope is that they toss out both the mag limit and the permit silliness.
 
Sure would be nice to see Oregon SC actually follow it's own precedents and uphold Raschio's judgement, but.... Seeing how the Fed "judge" Karin Immergut ruled, and how the 9th En Banc ruled the second time on Duncan V Bonta..... My opinion, the odds aren't that great that OSC will rule correctly. I would love to be proven wrong and we can move forward; but with the Fed cases being basically dead until US Supreme Court rules on Duncan V Bonta or mag bans and permit to purchase schemes.....

However, the Court did raise valid questions and did seem to be carefully considering the positions taken by Tony Aiello, the attorney arguing against Ballot Measure 114. As he has in the past, Aiello demonstrated a thorough knowledge of the law and once again did an excellent job defending the fundamental rights of Oregonians as articulated in the Oregon Constitution. Aiello was well prepared for every question and challenge from the bench.

This is the last stop for Ballot Measure 114 on a state level.

Given the makeup and history of the Oregon courts, it would be wise to not be too optimistic about the outcome. As usual, we hope we are wrong on this issue. And, keep in mind, that, irrespective of the outcome, the Oregon Legislature will continue to enact every possible impediment to gun ownership in Oregon even as it seeks to protect criminals and the violently mentally ill.

Our federal lawsuit against 114 still languishes in the 9th Circuit and probably will for some time.

Our thanks to Mr. Aiello for a job well done. Now we wait.
 
I watched it all. My thoughts fwiw:

IMO the keys to the case for the judges, looking only at judges responses and not m114 as written or previous rulings:

Can they rule based on public safety only or do they need to look at factual analysis?

Did appeals court conduct analysis about is the right unduly frustrated?

Does permit process unduly frustrate the right? Does mag limit unduly frustrate the right?

I ranked each judge 1-10 based on will they vote to affirm the appeals court ruling. 1 = no, 10 = yes, 5 = neutral or no real indication:

Tockey - 1
Dehoog - 1
James - 4-7, 4 mainly due to permit, but being that he is so concerned about free speech and consumer protection stuff i could see him also as a 7
Bushong - 5
Flynn - 6
Garret - 6-7
Duncan - 8-9

I could be wrong about Garret.

Tony was really, really well prepared. He did an awesome job.

I think this case will come down to one thing. Will they vote on what the law actually says, or what they feel is right? If they vote on what it actually says we have a decent chance.

Another key is if they feel the appeals court did not use the right process, for example that the appeals court should have relied on the facts and not just that the public good outweighs everything, then I think this will be knocked back down to appeals court to redue it. My gut tells me this is what they will do.

I believe that after it goes back to appeals court, that court will add some BS to justify them ruling on how they feel, not on the facts, and the ruling will be the same. Then it will go to the Supreme Court again. I could be wrong, but that's what I think fwiw. The biggest positive I see is there is some genuine questioning going on about did appeals court do it the right way. That is excellent imo.

If they vote on feelings it will be 5-2. Or 4-3 at best. I just think they aren't happy with the appeals court process but who knows. First time I've ever seen those individuals so someone who knows more about them could judge better. I will say though in the past they have honored the right process. They twice had the opportunity to grant the states motion to start m114 while it goes through the courts and turned it down twice. That says something. If they were on a crusade like the CA 9th they wouldn't have done that imo. IMO James will vote on his feelings. Don't know about the others.

That is the states attorney in front of the Oregon Supreme Court being questioned about measure 114, where he is trying to defend it. He looks like an idiot. That is wild that the news reported it that way, with that music over it!! Wasnt expecting that at all!

Interesting. Just a guess but perhaps Facebook shorts are outside the formal chain of content approval? Fe what's on tv news probably has many eyes looking at it before it's aired. Could be that Facebook shorts are not under any review prior to posting. Fe if Facebook employee thinks job is to stir up interest, create drama. Oh wait, they all think that's their job! :s0112:

Yeah that was why I was so surprised- it is very biased, but actually in our favor!! Pretty wild for the "liberal" media. Agree, I wonder if we have some moles on our teams side in there :)

I constantly bang the drum of "Our rights are never up for a vote, it's set in stone and remains untouchable" and that has really gotten folks fired up!

The outrage over the gas tax increase and how it was sleazed through haven't stopped Salem and likely this will be just business as usual yet again. Don't know what it will take voters to use their power to protect their freedoms.

I believe the outcry from the gas tax will prompt people to take action if they haven't already done so. Once the law is signed, we can apply for and start the petition to vote out the most noxious portions. The people have the opportunity to act on this and I'm hopeful that, with the preparations in place, we should be able to get it on the ballot. I also believe this may be the upswell we need to get people to wake up and do something other than sit around and *itch about things on the internet.
 
KoTax has until Wednesday to sign bill ...... Then , instead of 90 days to get signatures , it'll be less than 49 days just like the " Democracy " Governor who supposedly works for all Oregonians had planned . Funny how they move the goal post on issues when it doesn't fit their narrative eh ...........
 
It's not just the per gallon fuel tax increase. Vehicle registration fees are increasing another $84 for the 2 year registration period. Vehicle title fees will increase another $139.00.

Boat title and registration fees are increasing. New fees for smaller water craft are created and/or increased. Additional access fees are being imposed.

Fishing licenses increasing 14%, 6% and 6% in 2026, 28 and 30.
Hunting licenses increasing 12%, 8% and 8% in 2026, 28 and 30.
...and there's a new fee for fishing in the salt.

A money grab worthy of a criminal organization is underway. An increase in the baseline cost of living in Oregon is being codified. It's impossible for the average citizen to review all the newly created fees and tax/fee increases being passed into law by our POS governor and legislature.

Why is there a budgeted line item spending $1.5 billion on (illegal) alien medical care?

Why is new law being written giving (illegal) aliens access to the same housing, food and array of welfare benefits available to US citizens? Why are (illegal) aliens being given in-state tuition for higher education?

Why is the State of Oregon doing nothing to prevent criminal cartel organizations entering and doing business in this state? Who do you talk to about investigating campaign donations, consulting/professional fees and outright pay offs that buy this conspicuous blindness to the criminal activity.

The (politics) of the state of Oregon has become a cancer feeding on the citizens of the state.
