I definitely believe the key word "criminalizes" should remain in the final ballot title. For those voters undecided on this measure, "criminalize" denotes that this measure will unfairly penalize law abiding gun owners for simply possessing the firearms being banned. Hopefully, many voters will refuse to "criminalize" their fellow citizens for having done nothing illegal.

I noted in my letter and subsequent title as "severely criminalizes". Criminalizes does not do justice to what they are going for. A B felony is a serious crime reserved for robberies,rapes, burglaries, and serious assaults. Charging law biding citizens to that level of crime for owning what was bought legally is absurd. Also i noted that this "exception" is rigorous
 
I was speaking with my 80 year old mother yesterday who was raving about her latest quilt project as that is what she does for a hobby. I made a comment that "at least no one is trying to ban your hobby. The left is trying to make me into a criminal because I own a gun". My dear, sweet old mother who in days gone by would stomp around in the woods with a 30-30 hunting deer said " Well.. I don't see why anyone needs a semi-automatic gun". :s0054:

I was driving at the time and nearly ran off the road. My mother has always been a bit left of center, and largely ignorant of guns. I said in response, "Oh mom... don't buy into the media hype". I then told her that if the latest initiative becomes law of the land, her father's WWII 1911 would become illegal, along with my sons 10-22, semi-auto shotguns, etc. I also explained the difference between full and semi-auto, as she thought they were two terms for the same thing. Then I said "so, lets say this happens...semi-autos are banned, and the next day, some tweaker shoots up a place with a lever action like your 30-30 in the closet. What do you suppose the next ban will be going after?" I then told her how jolly ole England has had such a rise in murder by knives and swords, they already banned guns, so they ars now coming after anything with a point more than 3" long. I wrapped up with how years ago when duck hunting with my childhood friend, him shooting a semi-auto 12 gauge and me shooting a pump action, I was actually able to keep up with his rate of fire, and sometimes exceed it with my lowly pump..... Its not a problem with the gun these days, and start focusing on the finger pulling the freaking trigger, not the gun.
After this 30 minute discussion, she finally conceeded my point.

Sorry for the long winded post, but all of this was to say: this is who is going to vote this initiative into law if it makes it to the ballot. I was able to eventually show my mother the error of her thinking, but I wouldn't bet against her voting for this travesty still... and she has at least SOME experience with guns. The wording on the is important, but for people like her, and I fear there are a lot of them out there, they are going to think "No one needs a semi-auto" regardless of the ballot title. The general public is completely ignorant about this subject. How do we change that?
 
Not sure if it has been mentioned but ALL submissions for objections to the ballot title MUST have a signature! If you do not sign, it will be tossed out! Resend again with a signature if you forgot.

Nobody needs a smart phone. At least we have Constitution on our side. Some people do need a semi auto firearm. Manipulating an action in self defense could cost certain people their lives.

This is why the measure was titled assault weapons, not assault rifles. They are betting on the general public not reading or understanding the fine print, voting for this thinking only evil black rifles will be banned. When actually, in one fell swoop, its the evil black rifles and 80% of all other semi autos out there. Plus turning citizens into felons if they don't comply and register. Those not familiar with or owning firearms probably do not realize how draconian and repressive this measure is.

And when we try to educate people about its hidden agenda, we are labelled as bad people or not valuing the lives of children. The emotional aspect of this campaign leaves little room for truth and facts...
 
Well, a good friend owns a gun shop; he told me they plan to file a law suit; bc IP43 will shut them down.

Not sure of all the details.

I would buy into a class action law suit....:D

As if there wasn't enough reason, there's one more. I'm sure many ranges and such would shut down too. There are far more civilians in the state with firearms than LEOs or military.

Tell all your friends that you have to have standing to sue... the 20 year old 15 round Beretta 92FS magazines I have sitting around should qualify, but the state has no record of those so I would not be at risk for owning them. So I went out and bought a brand new Ruger AR-556 just to make sure. :)

Defense Minister, that's an excellent ballot title clarifying the ambiguous "assault weapons" with specifics and denoting the "felony" consequence on law abiding citizens.

Something to keep in mind and take advantage of here is that we currently have a right-leaning SOS, so please jump on board as this is our opportunity to potentially make things easier on us for the next time. Unfortunately, there will be a next time...

State Initiatives and Referendums
Next month we will begin formal rulemaking to adopt permanent rules relating to the state initiative and referendum process. We intend to put forward the current temporary rule with the State I&R manual dated January 10. We invite additional changes you wish to have considered for inclusion into this manual that will be in effect for the 2020 petition cycle. If you have any suggestions please get them to us not later than Friday, May 4 and we will consider whether to include them in this version. Please send suggestions to: [email protected]

My response was as follows:

In regards to rulemaking changes to the state initiative and referendum process, please consider adopting a rule requiring the state to provide a template/form for registered voters to use in petitioning the Oregon Supreme Court to review a Certified Ballot Title. Oregon Rules of Appellate Procedure, Rule 11.30, is difficult for the average voter to navigate, and Oregonians shouldn't have to hire an attorney and assume the associated expense simply to have a voice in their government. A template/form provided by the State would allow more registered voters the ability to be heard at that stage of the initiative and referendum process, and a link to the additional form should be inserted on page 21 of the State Initiative and Referendum Manual along with the current link to Form SEL 324 - Notice of Ballot Title Challenge.

Here's a possible 14 or 15 word ballot title:

Requires registration or confiscation of most currently-legal semi-auto firearms; felony for non-compliance

Confiscation is the only legal alternative to registration if you stay in the state. They don't say they will go around taking them from people (and they don't say they won't either), but it's confiscation in any event - give them up, destroy them, sell to a dealer that can sell to the police/military, take them out of state.

The Oregon preemption law only allows the state legislature to regulate firearms. The ballot initiative process must supersede state law:

ORS 166.170 - State preemption - 2017 Oregon Revised Statutes

Question: if this passes and you register your guns, then move out of state later, can you legally take your guns with you? I guess you could say: "I'm going to a shooting range in another state" if they stop you while driving your U-Haul truck on the way out of the state :mad: - but they don't provide any guidance on moving out of state (or even moving within the state) in the IP43 text. Legally you're only allowed to transport the gun to a shooting range, gun smith, etc per IP43.
