I'd like to read the actual senate bill rather than someone else's take on it. Sounds like the bill would be more for the likes of al-Alwaki than Joe Beercan.

W kicked the ball off when it comes to detention w/o trial. You remember Jose Padillia, right?

Padilla was arrested in Chicago on May 8, 2002 on suspicion of plotting a radiological bomb ("dirty bomb") attack. He was detained as a material witness until June 9, 2002, when President George W. Bush designated him an enemy combatant and, arguing that he was thereby not entitled to trial in civilian courts, had him transferred to a military prison. Padilla was held for three and a half years as an "enemy combatant" until, after pressure from civil liberties groups, the charge was dropped and his case was moved to a civilian court.

The quoted items are true but misleading as this is left out:
"Defines "hostilities" as any conflict subject to the laws of war."
So, unless they declare war it doesn't apply, but still worried: What if they illegally declare martial law on some put up pretense like the Occupy movement?

I case you weren't paying attention a few weeks ago, due to recent legislation, signed by the pres (after he said he wouldn't) the U.S. (domestic holdings included) now has a "battlefield" designation.
In that legislation, language was inserted, denying the dotgov the ability to detain citizens by the (our) military indefinitely.
So here we have legislation that modifies the Immigration and Nationality Act, allowing the dotgov to remove your status as a citizen more easily, even if you were born here to parents born here.
Thereby circumventing the amendment(s) in the previous NDAA bill.
