Overview - Drone Operator flew his craft over a lake used for Duck Hunting. Craft was peppered with shot. DO has hunter arrested.

Was the DO harassing federally protected wildlife (to wit the ducks) ?
Can the Sheriff prove the Hunter targeted private property (much like when they blast signs) ?
How stupid do you have to be to piss off a guy with a 12 ga ?



I for one, believe drones (quad copters mostly) should be classified to follow all laws RC Airplanes have to follow.

Good lord! Was this guy AWARE he was flying around bird hunters?? The whole damn state is frozen solid this time of year. Surely he could have found some other water to get his jollies over? Seems like Utah is becoming as punk as Oregon, what with all the "I can do what ever I want" attitude!

Dang. He should check if there are hunters around this time of the year. On the other hand that is a $5,000 drone. Now I am glad I fly drones and hunt so I know to watch for that kind of thing.
 
It's very simple - right or wrong (mostly wrong), the FAA has classified drones as "aircraft". And, they have applied the same federal regulation to damaging a drone as to any other "aircraft". So, as of 2016, shooting at a drone is a FELONY offense. Again, right or wrong, that's how they are considering it now - even it the drone is over your private property.

Short answer - don't shoot at drones, unless you want to go to jail.

But today the FAA in response to my questioning confirmed that shooting down a drone is a federal crime and cited 18 USC 32. That statute makes it a felony to damage or destroy an aircraft. SOURCE: FAA Confirms Shooting A Drone Is A Federal Crime. So When Will U.S. Prosecute?

The FAA now classifies an attack on a drone under this section of federal law:

2. Aircraft Sabotage (18 U.S.C. 32)
Amendments to 18 U.S.C. § 32 enacted in 1984 expand United States jurisdiction over aircraft sabotage to include destruction of any aircraft in the special aircraft jurisdiction of the United States or any civil aircraft used, operated or employed in interstate, overseas, or foreign air commerce. This statute now also makes it a Federal offense to commit an act of violence against any person on the aircraft, not simply crew members, if the act is likely to endanger the safety of the aircraft. In addition, the United States is authorized under the statute to prosecute any person who destroys a foreign civil aircraft outside of the United States if the offender is later found in the United States or, effective as of April 24, 1996, a national of the United States was aboard such aircraft (or would have been aboard if such aircraft had taken off) or a national of the United States was a perpetrator of the offense. Agreed, fly your drone into an active hunting area, you're begging for trouble - unfortunately, your foolish choice is likely to put someone else in jail.

Now, I also know, though I don't know where to find it yet, that it is also against the law to use a drone to in any way interfere intentionally with any kind of legal hunt - including trying to drive off wildlife. So there is a balance of some sort here, just not sure what it is.

I am not a hunter but I do understand the amount of money including time off work hunting can cost. If some drone operator chased off game or what have you, I can see that as a loss into over $1000 and felony territory.

I work with a few people that have drones and hear what some think is funny. All I've said is keep it away from my property or it will end up with all the other balls in my backyard.

As I understand it - the person who did this and posted it, is under investigation by the feds - big surprise - do stupid things, win stupid prizes :rolleyes:

this kid is always in the news lately, he did not show up for the hearing under the advice of his attorney(I think it was his attorney father? because he wasnt violating any laws) he responded to the meeting by that very day uploading a video to youtube of a drone flame thrower taunting the FFA and BATF...

last July Clinton police announced they charged him with enticing a minor with a computer, attempted sexual assault and possession of child pornography after police say they found child porn on his cellphone.
Last year, Clinton police charged him with assaulting officers. The case remains pending.

A drone operator should have no more special privileges or rights than a guy flying a kite, IMHO. However, these drones are flying over our heads invading our privacy and there's not a damn thing we can do about it???? If we shoot one down, it shouldn't be a felony charge for us, but a warning to a scheming chit of a drone operator....

He wasn't out there trying to get "beauty scenes", he was out there menacing and harassing. Some poor hunter took the bait and paid the price. Something needs to be done about these people who think it's alright invading someone else's privacy and harassing wildlife to boot. The govt. and laws protect the wrong people at times and that's what we need to get changed....

And it's exactly that kind of behavior - invading an active hunting area, that gets the feds involved in the first place. Bad choices by stupid people, and we all have to be punished. It's the way of government. Oh for the days when people could settle disputes without the government getting involved.

Wow. We've come a long, long way from the flintlock.

If they're going to classify drones as aircraft with attendant felony charges for taking a shot at one, then the operators need to be trained as pilots and go thru all the hoops to get a license. As it stands now, they're overpriced toys operated by untrained, uninsured, unregulated ($5 permit does not count as regulation) and unsupervised individuals whose only qualification is having a credit card to buy the damn thing.
