The form doesn't explicitly state which of either State or Fed is being used for the drug question, so since it's ambiguous, the normal person will default to answering within state law, which is simply pass or fail depending on the state.

All states have the right NOT to comply with the feds. Take Montana for example..... For years they had not posted speed limit even though the feds set a max speed limit for interstates. It wasnt until the feds where going to cut funding from them that they ever changed.
