It was about the round count in sarcasm over the situation. Criminals don't care about the laws or rules.

Got it! I figured it was about round count but maybe that of the employee.

I could easily see where a shrewd lawyer would point out the employee had a mag in excess of 10 rounds (if he in fact did) and and maybe use that in defense of his criminal client to maybe exonerate him - and the rest.
