Status of Oregon Gun Control Bills as of 5/24/2023
Senate Bill 348 replaces most of Measure 114. The bill makes Measure 114 even worse with a mandatory 3 day waiting period, to receive a firearm you purchased, after approval by the state. A 60 day wait for a background check, increasing the cost of a purchase permit to $150, and retaining the standard capacity magazine ban. The bill passed the Senate Judiciary Committee with a "do pass" recommendation with subsequent referral to Ways and Means. The 3-day hold and retroactive standard capacity magazine ban go into effect immediately when signed.
House Bill 2005 passed in the House and has been sent to the Senate. HB-2005 makes it illegal to possess an unmarked/unregistered firearm, including an unfinished 80% frame or receiver. Defines the upper of an AR platform firearm as the firearm, and requires marking and registration of all existing and new AR 15 uppers. This is in addition to the federal regulation that makes the lower receiver the registered part of the firearm. Essentially, your AR platform firearm will become two registered firearms. It will be illegal to import an unregistered AR style upper into the state. Makes it illegal for anyone under 21 to possess a semi-auto firearm of any type. Allows any local government entity to restrict carry of firearms by CHL holders in any government buildings and nearby areas, including adjacent parks and private businesses.
House Bill 2572 passed the House and is in the Senate. The bill is a confusing mishmash about private individuals directing traffic, wearing military type uniforms, and training as a militia. The authors say there are no criminal penalties. However, once defined as an unlawful militia, members will be held responsible for civil penalties and damages, even if you weren't at the location. Basically, if three or more people get together, they can be called an unlawful militia. There are enough loopholes for directed prosecution that it's obvious the legislation is meant to exclude groups like Antifa and BLM that caused the riots in Portland a few years ago. It's clearly aimed at anyone belonging to groups related to the January 6th events. Won't matter if you were there or not, you can be held responsible if the overseers determine that you may be a part of the group.
Senate Bill 393 forces a 3 day hold on receipt of a firearms AFTER the sale is approved by Oregon State Police. This has been passed to the Senate Judiciary Committee. One version has the 3-day hold effective on passage and the other has a 91-day delay. Either version could be adapted but there has been no movement of this bill.
Senate Bill 527 allows retailers to refuse the sale of ammunition and components to those under 21 and refusal of gunsmithing services without fear of age discrimination lawsuits. On 4/3, passed out of Senate Judiciary Committee to the floor with a "do pass" recommendation.
With the Senate currently unable to vote on any legislation due to lack of a quorum, it's uncertain what will happen to these bills. However, it's still important for people to continue to write and call your legislators, in both the house and senate, and tell them all of these unconstitutional bills must be stopped.
Measure 114 lawsuits
There are currently two lawsuits. First one was brought by Oregon Firearms Federation, four Oregon Sheriffs, and two Oregon gun shop owners. The lawsuit has since been joined by lawsuits from Second Amendment Foundation, Firearms Policy Coalition, and National Shooting Sports Foundation (NRA). Federal trial is scheduled for June 5th through 9th.
The second lawsuit was brought by Gun Owners of America, Gun Owners Foundation, and two individuals. The Judge issued a Temporary Restraining Order (TRO) against implementation of Measure 114. This trial is scheduled for September 18th through the 22nd in Harney County Circuit Court.
