It's not a "loophole", it basically says the Hughes NFA restrictions don't apply for transfers TO or BY Fed, State or political sub-divisions.....Then to the West, in West Virginia, they proposed a bill which takes advantage of a little-known loophole in 18 USC 922(o) , Hughes Amendment, in which a State could transfer (post sample?) machine guns to qualified citizens and those citizens could possess them. If there's a thread on this, already, I haven't seen.

The general understanding is that the exception is for LE/Military and corporations trying to get mil contracts.
