Mr. Yoder , I would like to thank you for your efforts a getting this changed. My son had his records expunged over a year ago and has tried to purchase a firearm numerous times, but was always denied. He tried again this past week and was approved.
I would personally like to help you out with the cost of this and also feel that everyone that has benefited from this judgement should do the same.
That's amazing news! From the beginning of the battle, one of my top priorities has been to get this fixed for EVERYONE. Here we are! 🙌

The community support and encouragement has been great, thank you all! While I have been the most vocal about this, there was myself and 4 others that were plaintiffs in the case, and 2 others in a fairly similar status. There were several attorneys working on this as well.

We are seeking attorney fees to be reimbursed from OSP/DOJ, and I'm looking into some additional things relating to this case as well. Namely the possibility of filing a federal lawsuit against OSP, to seek compensation for everyone impacted. I'm not sure if it will gain traction or is feasible, but maybe?

Additionally I'm not done fighting for our rights. OSP sparked something here, and I'm going to keep fighting.
A close friend and I have our eyes on SB243 as well. I will likely start a SB243 Lawsuit thread if we can get a suit going for that.

Im in the same situation. I went to do a transfer Friday 11/14 and was delayed again. I called the number yesterday. Should i also follow up with an email similar to the one above??
 
Too bad it doesn't apply to "similarly situated individuals", but at least it demands changes at an institutional level.
I was also one of the people suing OSP and coupled with Mr. Yoder's law suit. While it does not apply to similarly situated individuals, the judge issued a warning to OSP and DOJ for Oregon that if they continue to be sued for the same thing that has been adjudicated already (the fact that we can sit on a criminal jury) that they are going to start imposing sanctions.

That said, I am an FFL holder and now my set-aside is recognized.

Immediately following the judgment, I heard from a couple other FFL holders that they randomly got dozens of previously denied transactions reversed to approved, so I am thinking they are back on track with approving them but we need to test the theory.
 
Not sure exactly when OSP will have it fully sorted for everyone, it took about 5 days from me getting my judgement before I was good.
My attorney didn't give an exact date. It might be all good now, it might be a few days.
If you get delayed or denied you can always appeal it, and call the FICS Supervisors/Manager.

I'd expect it should be all good probably by next week. Unfortunately OSP doesn't keep things updated so it's hard to know for sure.
When I got the temporary injunction, before the final judgment, it was funny, before I got home from court, my employee called me and was like I guess court went good because on FICS's website all your previous denials just were reversed to approvals. This was Wednesday before Thanksgiving last year and the DOJ's attorney told mine he would call OSP because he was worried I might go on Black Friday and try to purchase and judge Geyer informed them that the have to approve all transactions.

It was hilarious!

I wish I got off with only the 5k, but I went in extremely proactive and hired expert witnesses and filed for temporary restraining orders against OSP.

What was hilarious was in the middle of my hearing, the judge had another hearing he had to do, so they had us step aside to hold a quick hearing. It was a restoration of firearm rights. The court room erupted in laughter.

What was awesome is most of all the heavy hitter 2A attorneys came to support my law suit for that hearing. We had the gallery full of attorneys from all over. This was before they joined our cases together.
 
So I had my my felonies set aside about a year ago. Should I continue to wait or should I try to purchase and see what happens?

If you're delayed, appeal it. Tell them that you have no prohibitors, anything that would have been has been set-aside and that with the recent court outcomes they aren't supposed to use that as a basis for denials.

You know when it goes into effect?
Let me clarify, I do not know that DOJ has officially said they are scraping their Expungment stance. My lawyer, Leonard Williamson, has said there has been nothing in writing. However, we have been seeing those not involved in the lawsuit who were previously being denied start getting approved.

The Marion County judge issued a warning that if they keep denying on the issues that have already been adjudicated, that he and other judges might start to impose sanctions, so I think they are starting to approve them already. Stop by and we can test it out with a purchase.

Oct 2016 fully expunged possession charge from out of state.
March 2025: I loaned Sportmans $700. (P365 fuse) and immediately got "pending/delayed"
April 2025: Called and emailed them copy's of my paperwork that was stamped by the district court proving they are real and filed with the court clerks office.
May 2025: I called again and emailed again. Mind you there were a lot of talks about M114 back then and I have yet to hear anything from the OSP.
August 2025: Completely forgot until I found a receipt for the sig and decided I was done loaning sportmans my money and canceled my purchase in defeat while awaiting Mr. Yoders case.
11/14/25: I decided to give it another go and talked to a buddy about buying one of his old .22s and started a transfer.
11/15/25: I got the dreaded call that I'm "pending/delayed" again. I yet again called and left voicemails and emails.
11/17/25: A troopers from the OSP called me and told me that he did not see an expungement on my record and I explained to him the situation and he found all of my previous emails and acknowledged that they were never opened. He said he was going to forward it to the "background research team" and if they have any further questions they would reach out.
11/19/25: I am sitting here hoping to receive the call getting my hopes up reading everyone's victory's. I will update y'all when something changes.

That's a little different of a situation. Oregon can't look at other states expungement data, California actually got overruled on that in the 9th Circuit when they tried to use someone's AZ expungement against them. However, if that state still has an FBI prohibitor on file, there could be an issue there.

Was the "Out of State" California by chance? The reason I ask is a buddy of mine has been dealing with issues from there. Apparently California has 2 types of expungements. He's now having to go through a pardon process because he got the wrong expungement. Even if not California, might be a similar type of thing. I know another guy that had stuff in Nevada. Nevada expungements don't restore firearm rights, you have to separately appeal to the pardon board there for that.
Anyway, point being, the other state might have something silly like that going on. 😵‍💫 Hopefully not and Oregon is just getting hung up on something stupid and it clears up.
