I found this forum by doing a google search for NICS, Delayed, and WA CWP. So here's my story.
Every gun purchase I've made for the last 20 years has started with the famous "Delayed" so many people talk about. To my knowledge NICS has never responded after the delay. I've always waited the prescribed number of days and picked up my gun.
So the other day I went to buy a handgun at Sportsmans Warehouse, got the expected "delay." Then when I asked what day I could pick it up I was told they do not follow the "Brady Law" and I would have to wait for a "proceed" before I could get my gun. I can say I won't be buying any more from Sportsmans Warehouse. Don't know the outcome yet as my "day" will be next tuesday.
So I went to another gun store and asked if they followed the Brady Law. They said yes. While I was there I looked at another gun and (damn!) I decided to buy it. Got the expected "delay" and asked what day I could pick it up. They said there was a Washington State law that said I had to wait 11 days before I could pick it up. They couldn't tell me "what" law that was. Since I've never heard of that law I decided to do some research. So far I have found no such law, but I did find the updated Brady law at Permanent Brady Permit Chart | Bureau of Alcohol, Tobacco, Firearms and Explosives that says no NICS check is required with a <5yr old Concealed Carry license. I contacted the salesman at the second place and told him about that. He said that any decision was above his paygrade. He was very interested because he too suffers the "delay" syndrome. I'm currently awaiting a return phone call on that. My "day" for that "delay" timeout will be next Thursday.
Haven't decided how I'm going to handle SW yet. I don't expect a NICS response.
I've had a Washington Concealed Weapons permit continuously since the 70's when it was a "May issue" state.
Any ideas on this subject?
 
My suggestion is to get an FFL. All it takes is money and depending on how many Handguns you buy each year and what you are paying for transfer fees. Well it might be cheaper and I don't believe you will be delayed again.

I am not an expert on Washington Law... So take this with a grain of salt.

The info on the FBI website about Washinton CPL holders being exempt from NICS checks is outdated and no longer valid. It changed when Washington started tracking pistol sales and implemented 10 day waiting on handguns (is my understanding)

When I was in Washington and in the same boat (having NICS problems while holding a Washington CPL) I had my lawyer check into it after reading it on the FBI website and was told it was a no go.

Delays are a PITA , I get one on occasion...Pretty sure its 'cause my name isn't that uncommon.
Looking forward to a positive outcome and range report about your new guns...

I actually had an FFL back IN the 60's until they raised the cost so prohibitively. They did the same thing on my PI license too.
 
The FFL is far more reasonable but then the State wants $135.00 and your first born for the Pistol Sellers' License. At least, I think that's what they still want. Like I said, depending upon how many Handguns you buy and what you are paying for transfers, well it can be a good thing.

That's not good to hear. But the site indicated it was updated in May of this year? Where would I find the statute on that 10 day waiting period?

Thanks for suggestion, but I don't buy that many guns anymore. This would be the first in a couple of years.
 
The biggest problem I see is that our so called Law Makers(& of course the AG) feel that they simply have to keep writing new laws. And those same _____s can't be bothered to pass the new ones out to the Man on the Streets. And then there are all the "regulations" which ain't really laws but still have to be addressed.
 
I hadn't heard that anything changed:eek:. About a year ago I walked into Bi-Mart in Sunnyside and out with a Shield. WTH?
I was reading the I-594 and while I'm not an attorney it seemed to indicate a recent (since 2011) CPL provided an exemption to background checks and waiting periods. I'm beginning to think a lot of the problems arise from the store's mis-interpretation of the law's requirements.

OK so you need to take a little personal responsibility here and contact ATF in your state of residence and apply for a UPIN Unique Personal Identification Number .
This will Solve the Delayed responce From NICS It's not anyones fault but your's you can't expect the big box store to jump thru hoops
Just my 2 cents hope this helps .
