I thought it would be worthwhile to start a thread dedicated to defeating IP 60.

IP 60 is a ballot initiative that seeks to ban all firearm magazines over 10 rounds capacity, and takes first steps towards banning semi-automatic firearms.

This thread should be used for collecting and disseminating all relevant news, information, calls for action, etc. regarding IP 60.

Written comments are due by January 29, 2020. I will follow-up with details regarding strategy.
Challenges to the ballot title for Initiative Petition 2020-060 can be filed with the Oregon Secretary of State via email at [email protected]. The best way to do this is to print your challenge on a printer, sign it in ink (because it is a legal document that gives you standing later in court), then scan it on your printer or cell phone and attach that document to your email.

Comments like "Shall not be infringed" are not helpful, nor are comments about the ancestry of Oregon politicians. Comments about the sufficiency of the ballot title in describing the measure, that it is misleading, inaccurate, or incomplete, are helpful. Comments about its constitutionality, such as that it addresses two separate topics (if in your opinion it does), about how it violates existing SCOTUS case law (e.g. Heller and McDonald), about how it violates the Oregon constitution, about how it is an expost facto law, etc. are helpful.

The point of filing multiple challenges to the ballot title is that the challenges must then be investigated by the state attorney general. That takes time, and the time it takes gets subtracted from the time the proponents have in which to gather signatures. They cannot gather signatures until they have a final, approved ballot title. Also, those who file challenges can later challenge the measure in the courts. They can be the plaintiffs in lawsuits brought by organizations like the NRA against the measure.

This is not rocket science. It's easy. I've done it before. Let's file a few thousand challenges to all of these ballot measures.

Regarding the unconstitutionality of firearm magazine bans:
In one of the strongest judicial statements in favor of the Second Amendment to date, Judge Roger T. Benitez of the U.S. District Court for the Southern District of California determined on Friday that California's ban on commonly possessed firearm magazines violates the Second Amendment.

Please see that the Secretary of State has rejected one initiative 54 on the grounds of spanning multiple subjects yet did NOT reject initiative 60 on the same grounds. Unfortunately, this is quite telling in how the SoS feels about such anti gun laws. That she is allowing this to be funneled through is deeply concerning.

What a load of crap. And another example of where this state has gone; lots of rain and Socialists. I see dealers are exempt; glad I have an FFL. Might work until we find the hacienda in Arizona.

We need to encourage more individuals to get an FFL. It would be easier to justify getting one if multiple FFLs could share space rent/cost. A subject for another thread.

It really isn't difficult. Compared to the unmitigated horsecrap I deal with the .gov mouth-breathers in my day job, it was a walk in the park. :s0155:

I dealt with an FFL recently who has been in business a long time. I asked him when was the last he got audited. He said it had been decades ago. I guess he may be one of the lucky ones.

All over the board, as far as I can see. I had a collectors license and had an audit in 2009. I'm told likely slightly over 0% of 03 FFLs are ever. The kitchen table FFL I was doing most of my antics through until he moved/I got licensed told me he was never audited in 24 years. And I know I guy who gets one every freaking year. So far, I've been licensed about two years and, knock on wood, not one. (shrug) Who knows.

I certainly hope you are wrong, because if any of these unconstitutional ballot measures pass, you can be sure that the gun-grabbers, elated by their win, will be back for more with a vengeance.

Agreed and the SCOTUS seems to be in hurry or agreement in bailing us out. If they refuse to take the NY case I will be bummed out.

With all likelihood the only way to defeat these is to have them pass and then overturned in the courts.
 
Correct. The only good news about the IP magazine ban is that violation of them is misdemeanor and you can still own your previous magazines. That's much better than last years IP which made it a class B felony and you had to permanently alter or sell standard magazines.

Yes I am aware that this "good news" means they decided to use lube when screwing us over. It's still bad and we need to really fight these three IPs hard.

This is also a good argument to be made before January 29th. I'll be working on mine, to get them in before close of business Friday...
