Taking this article in the paper at face value, sounds like the NOBODY should be charged. Aint "choke holds" illegal? Sounds to me like some whiney jackwagon got his azz whooped then cried.

2. Walk away.
3. AFAIK, he who calls the popo first is the winner of the afterfight.
4. AFAIK, he who makes the first physical contact is the one that gets charged.
5. Was he pushed away one handed or did he get pushed down?
6. Was it a headlock or a chokehold???

If, and only if, it was a chokehold would breaking a glass in the other guy's face be a reasonable use of force. Size disparity aside, one is not likely to be injured by a headlock unless the other is wrenching the head around.
 
The problem is that it won't be "free". he'll need to hire an attorney $$$
He can always sue for compensation in a civil court, but he may not want the defendant showing up with a gnarled up face...
Whatever happens this guy is a winner in my book.

That's going to vary by situation, and by locality.

For example, attacking someone from the front and squeezing their neck with both hands creates the possibility of death or serious bodily injury.

OTOH, putting someone in a martial arts choke can be sometimes a defense.... and has been held up in court. Except for when the popo accidentally kills a perp.

And the other party clearly showed his intent with, what I'm sure was an in your face cussin.

I've had to choke a couple of dudes out in my day.... but it WAS in the line of duty, and only until they calmed down and realized they were about to get some bones broken.

Applied correctly, a choke such as a rear naked can be quite effective at calming down an assailant. ;)

Yeah well, THIS pussy doesn't need any problems, and I really really really dislike drunks. So I stay out of drinking establishments of the kind where the only purpose is to get drunk, and maybe pick a fight.

Disagree. Pushing someone one-handed is some perps whiny excuse for what was probably a two handed shove of the kind we saw in the case of the fellow that shot McGlock.

If he pushed him down, a headlock might be warranted if the guy continued to close.

OTOH, pushing someone down may warrant a defensive chokehold.

Neither of us knows what really happened. That's the nature of fights, and the nature of reporting.

Intent won't come into play with a "headlock". IMO it does NOT hold the possibility of death or serious bodily harm, which a chokehold would. The laws regarding self defense are very clear on this subject. But hey, I'm no lawyer.
