Well, then it is still a failure of the constitution (and of those writing it and those ratifying it) - a failure to account for human nature. Ever hear the phrase, "concentrated benefits, diffuse costs"? That is the nature of what we face here. You can't expect ordinary Joes, trying to put food on the table, to spend time keeping track of scoundrels in office, and try to apply pressure to them. The people who make out in government are those IN government, and their cronies. Only those people have the time and sufficient motivation to influence the process - not to mention the resources.

Even with the best of intentions, government will eventually always end up in the hands of scum.
