If the guy just can't bring himself to shoot this kook he needs to move. It's pretty clear he is dealing with someone who has mental health issues. Because of this the courts will just keep letting him go and he will return again and again until he manages to do what he wants.

And oh by the way, gasoline indicates intent to commit Arson of an Occupied Structure, which IIRC is a Deadly Force Justification in WA.
