I could have sworn there was an BATFE FAQ entry on this, but I'm not finding it readily. If one has a homes in two different states are there residency requirements, as in percentage of the year, in obtaining an 03FFL (Collectors) license? The reason I ask is that while having a C&R is nearly worthless here in the 🦫 state, we have plans for me to reside in a free state at times whilst preparing the land for a family migration. My question is could I be so licensed and engage in collecting activities at that location. If it is a "no"or is an unknown, I'll just wait. But I did enjoy C&R-ing back in the day. Thanks much.
 
You can use your c&r to buy anywhere in person it's an ffl, if your talking about shipping you can only have firearms shipped to the "business" location listed on the FFL not the mailing address (if they're different). I don't know of any state residency requirements just the requirement of a physical "business" address you can't use P.O. Boxes for the physical location

(Edit- I'm not a lawyer or an atf regulations specialist and I did not stay at a holiday inn so take what I said as my opinion 😂)
 
I dont remember seeing anything on this subject when I applied. You may need to call them to get an answer. Like said above in person you follow the law of the state - In CA for example you cannot transfer any handgun without going through an FFL. Only long guns. Not sure of the difference between your two states but I get why you would want to have the license in the more lax. I am in Idaho now and only need it if shipping in guns otherwise face to face - with CCW I dont even use it if buying from an FFL - I just do the paperwork - flash my CCW and walk out with it. Let them keep the paperwork on file lol

May a person who resides in one state and owns property in another state purchase a firearm in either state?
If a person maintains a home in two states and resides in both states for certain periods of the year, they may, during the period of time they actually reside in a particular state, purchase a firearm in that state. However, simply owning property in another state does not alone qualify the person to purchase a firearm in that state.

That answers the question in my mind. If you are residing in one State part of the year, buy firearms in that State. If you are residing in a different State the other part of the year, then buy firearms in that State. Try to get State ID in both States.

Sort of my thinking too. If you have a physical address in both states, reside in each part of the year, and documentation showing such, presumably one could engage in licensed collecting activities in the one with the lower Marxist infestation rate.

It is not particularly urgent, so I could certainly wait longer into this migration project. But C&Ring was fun and I do enjoy classic S&W wheelguns. :s0155:

Same concept should apply to person to person transfers as well, regardless of the C&R license.
 
Can you have a C&R license with your home address? And will they ship to your home?
Federally, yes. However, due to Oregon's brain-dead laws (i.e. SB 941), firearms can no longer be shipped directly to collectors, making the licensure largely pointless here. In free states, however, you can. Before Oregon passed the aforementioned statute I, and many others, did exactly that.
