California will probably appeal to the entire 9th Circuit which has a liberal majority. Here's hoping SCOTUS drives a stake through the heart of these shenanigans if it reaches them.

If a background check on ammo is an infringement, how can background checks on firearms NOT be?
 
Didn't CA UNDO this, (for a few days) and then reinstate it a couple years ago?
This mess has been going on since 2016. And it's already been up to SCOTUS once and got remanded back down. And it's still far from over.

This is such an obvious and monumental flaw with our system. The law was clearly unconstitutional from the start. Yet California has been able to tie it up and subjugate our rights for nine years because of how slow the judicial system is. And there are are ZERO repercussions for this which is why they keep on doing this crap and will continue to keep doing this crap...And using tax payer dollars to fund their tyranny.

This needs to change. It never will, of course. But one of the gun groups should file a class action suit and demand that California return all the fees it collected under this unconstitutional law...plus interest...plus massive penalties. None of that will likely happen either. But it should.

The case is, of course, not over. It will be appealed to the corrupt 9th via en banc and this decision will get overturned, and then it will take 3 more years to get back up to SCOTUS and who know if those feckless cowards will take it...again...or not.
 

In a fiery dissent, Judge Jay Bybee said the decision failed to correctly apply the Bruen test, and that using the logic of the decision, any firearms regulation could be interpreted as a violation of the Second Amendment.

This ^ was their justification for this? Someone correct me if I'm wrong but weren't those restrictions placed on people who didn't pledge loyalty to the crown?
 
This kind of crap (States doubling down and twisting things around to make unconstitutional law) could really stop quickly if the DOJ would start arresting and charging State officials, Legislators and Governors for violating 18 USC 241 & 242; "Conspiracy to deprive citizens of civil rights" and "deprivation of civil rights under color of law"

Edit. I mean, by putting real, tangible consequences for violating the US Constitution against the officials, it would send a clear message, that the Equal Protection Clause, Federal Supremacy clause, and incorporation of the Bill of Rights with the States, requires that States follow the Federal law, and that States cannot flout the Bill of Rights which put limits on the governments of the States and the Federal Government, to protect the rights of the People.
