The 9th circuit already said that the law was unconstitutional with Benitez's ruling. Why is this being heard again within the 9th circuit?

In the appeals courts, a 3 judge panel goes first. Then, the loser can appeal to an en banc panel (the whole court) and they can choose to review or deny the appeal. The state and the court, want this to take as long as possible.

does not apply to any of the following:
(a) The manufacture, importation, distribution, offer for sale, or sale of a large capacity magazine ... to a law enforcement agency in this state for use by that agency or its employees for law enforcement purposes.

...which is nothing short of tyrannical, thus making this "law" invalid, null and void. And you cannot comply your way out of tyranny.
