If Democrats are successful in court packing, the Republicans would end up doing the same thing when they come into power. Before long, the SCOTUS would have dozens of judges and be completely politicized. As the makeup of the court expaned, whenever power shifted from the DNC to GOP or vice versa, many precedential opinions would come up for reversal. That would lead to the demise of one of the chief aims of decisional law: stability (the notion is that it is better to know that a law is stupid because at least you know how to not run afoul of it, than it is to not know what the law means).

Anyway, my opinion is that packing the court would cause further division and bring a hot civil war closer. If the last check on government power becomes a mere rubber stamp for government power, it will leave a lot of people feeling disenfranchised.

This isn't the first time such thing has happened.

Fighting over the Supreme Court has been an ongoing thing for generations.

Here's a good summary of where the case stands right now and how unusual it is for the issue of mootness to be such a hot topic: SCOTUS for law students: Battling over mootness - SCOTUSblog

Anyway, it looks like we will have to wait until some time after Oct 1st to learn SCOTUS' view:

For their part, the justices have taken no action, scheduling the question of mootness for consideration at their first conference after their summer recess, on October 1. New York's lawyers had hoped for quicker action, perhaps a mid-summer order dismissing the case, but for now they will have to wait.

LOL, I see it as......

Stacking a Jury (or the Court, as the case may be) is a time-honored (or dishonorable) practice amongst those in the Law Profession. Ha, ha, ha.....
