At least back in the 19th century even if a legislator opposed something that they felt wouldn't stand on constitutional grounds they would most likely argue against it. Not just saying it was wrong or the country couldn't afford it or people wouldn't support it, but actually argue why it didn't have a legal standing & shouldn't be supported.
