Yes. 40mm is NFA. Each and every non shotgun antipersonnel round for 25.4mm -40mm launchers are also NFA. Any cartridge over 1 inch that is not a "sporting cartridge" other than common shotgun shells (10ga,.maybe 8ga largest?) Are also NFA items, as well as the cannon or gun to fire them. Blackpowder cannons interestingly aren't as tightly regulated, although I seem to remember something about a certain age or size restriction? I could be wrong.
