Selling a fresh build with only 60 rounds fired for function test and zeroing.

With brace and muzzle device removed measures 26 1/8" overall length so it is not classified as a pistol or an SBR, but rather a "Firearm". Hence the fore grip on the short barrel. Non-NFA item. This was the intent behind the build. Parts List as follows:

How is this not a pistol or an SBR? Any rifle with a barrel less than 16'' is an SBR otherwise it has to be registered as a pistol and have no stock (brace is ok).
 
"An OAL greater than 26 inches [has the potential to change] the classification of pistol to firearm. Firearms in excess of 26inches OAL may have vertical grips installed and remain non-NFA. Pistols with vertical grips installed sub-26 inches OAL [can be] considered AOW and are subject to the NFA."

Simplest explanation easily found with a Google search. As mentioned in the ad, feel free to PM with questions.

I believe you are misunderstanding the information or the source found on google was inaccurate. I encourage you to call the ATF Portland office for clarification, the number is 503-331-7830

I'm not trying to create a problem for you but I also don't want someone who is not familiar with NFA items to buy an item that just for possessing could result in a $100,000.00 fine and ten years in prison.

It can only be one of a few things.
A shotgun
A pistol
A rifle
A machine gun- NFA
A destructive device -NFA
Any other weapon-NFA

a firearm can only start out as one of these six items, after that it is a modification of the initial item.
an AR -15 receiver starts life as a paper weight, as soon as it is more than 80% complete it becomes either a pistol, rifle or shotgun (yes they make a 410 upper). There are no other options unless you submit a form 1 and "create" an NFA item, in this case an SBR. Any firearm that is not created as a pistol, rifle, shotgun, machine gun or destructive device is an AOW (any other weapon) which are all NFA items requiring a tax stamp.

I believe you are looking at the legal verbiage assuming the build started life as a rifle. Read up on the Pistol, FIREARM (yes, this is an actual ATF classification other than what you've listed) and AOW classifications. It was built as a pistol, not a rifle. It has never had a stock on it. It has a brace and an 11.5" barrel. Due to the fact that said pistol also happens to be of greater than 26" OAL when measuring from end of buffer tube to end of barrel with muzzle device remover (as per ATF) , it can be classified as a "Firearm" as it is no longer considered "concealable".

If you actually want to buy it and it bothers you so much, the fore grip can be removed to satisfy your concern. If you have no interest in buying but are here to just cr@p on my thread, then mission accomplished. It took me quite some time to make this ad and it took you about 10mins to derail it when you could've just PM'd me.

There is plenty of information on the internet for you to read up on this subject. It has been discussed do death already.

Additionally, all the verbiage you posted is clearly referring to an overall length of less than 26". This build is NOT a rifle, nor is it a pistol WITH an overall length of less than 26". It began life as a pistol AND has a greater than 26" OAL. As insane as this may seem, this is the nature of these laws. A lot of them don't make sense but they are what they are as written.

I did my homework and researched the hell out of this prior to building it, including reading all the same info from the ATF that you posted and then some. I didn't just slap this thing together without regard for the law. Please do some extra homework of your own instead of using my ad to flesh it out, although at this point, it's a bit too late for that.

Not crapping on your thread at all, you have a very nice build. I originally posed the question because you said it wasn't either classification. IT absolutely can be non NFA with a short barrel and a brace but would Be considered a pistol requiring a minimum age of 21 to purchase and listing it in the pistol section of the classifieds. When you purchased the receiver and filled out the 4473, it earns its designation. It happens at this point because they can't transfer a pistol to a minor.
the vertical grip is the only issue with selling it as a pistol with a brace but that's an easy fix.
