Yeah but there's unfortunately two sides to deadly force. The letter of the law side, your probably right he was justified. Then there's the social and political side that probably isn't worth it.I believe felony use of deadly force would apply BG armed or not.

Deadly force is applicable.

The problem with this incident is applicable or not the guy was fleeing and, at that moment, not putting the officers life in jeopardy. The fact that the officer reacted at that split second and stopped firing, is impressive.
