A guy I know went to a local pawn shop to do a transfer of a .44 Ruger to a buyer. Apparently the serial number was a bit mangled and the buyer reneged and the pawn shop confiscated the pistol. Is this the proper procedure?
 
If the paperwork wasn't started I don't see any reason why he wouldn't have been able to leave with his own gun. But I may be wrong.

Wonder how "mangled" the SN was.

"Mangled" is such a vague word, could it (in the dealers mind) mean something like "removed, altered, or obliterated" as in:

§ 478.34 Removed, obliterated, or altered serial number.

No person shall knowingly transport, ship, or receive in interstate or foreign commerce any firearm which has had the importer's or manufacturer's serial number removed, obliterated, or altered, or possess or receive any firearm which has had the importer's or manufacturer's serial number removed, obliterated, or altered and has, at any time, been shipped or transported in interstate or foreign commerce.


I would love to know what the SN looked like
 
This is what I found .

Confiscation/Seizure: If a gun with a tampered or buggered serial number is brought to a shop, the dealer may seize it and contact law enforcement, as they cannot legally return a possible contraband item to a customer.
 
My question has been, what about selling a firearm now, that was bought years ago before having to transfer via FFL.
What if it was unbeknown to me, stolen when I bought it?

I had that happen 20 some odd years ago...was trading in a S&W .44 that I had bought a couple years before for something new at a shop. They ran the SN and it came up stolen. Of course my initial reaction was "Oh $h17!, I'm foo-kd!" But ended up being a non issue for me other than being out the cost I paid for it. Sucked financially, but was glad someone would get their stolen gun back. F theives.

Wa state, I'd assume it's similar most places.

Guns are just property, if no other laws have been broken. Guns in the evidence locker for whatever reason might be a different issue.
Makes sense. I was just wondering cause I've got a fair share of stuff from before the 2014 days that was hand shake deals (legally of course) that there'd be no way of knowing the history on the gun. I'd hate to go sell one at an ffl only for it to get confiscated because it was "stolen"

I'm not lawyer. But if it isn't something worth thousands, it's low value property.

A serial number matching a murder weapon would be something entirely different .

Heh...after my experience, I've kept all the "pre-941" purchases. I do miss handshake deals tho...really slowed down my "gun of the week" autism...
