ATF asks Court to dismiss a case as "moot" since the Pistol Brace rule had been "universally vacated" in other cases, meaning the Pistol brace Rule is no longer in effect, but claims that some "pistol braced firearms" will still be considered unregistered SBRs and that the "statutory obligations" of NFA are all in effect.

The case seeks to enjoin the ATF from enforcing the "legal theory" underpinning the Final Rule of pistol braced firearms. The ATF defends the "legal theory", and wants the court to dismiss case as moot.

So
Until the NFA and associated gun laws are either repealed or overturned, the ATF will continue to be dicks

In honor of Certaindeaf, I didn't click. But…

So they are applying The Double Negative Theory? 🤔
They lost both cases but the second one canceled out the loss on the first one limiting who they could go after so somehow that means they won and can now go after anyone?

"Hey, we lost the cases about this specific thing and were told we couldn't do what we wanted, but we're still going to anyway." Uh huh. Sounds like ATF's lawyer needs a head slap.

Here's the skinny.
This was a directive or interpretation from AFT "lawyers" not from AFT HQ. This is not as big a deal as many are saying it is. Also, for all of us that are GOA and or FPC members there is even less threat since we are covered under the injunction that still stands. Now, I'm not a lawyer, because my parents loved me, so advance at your own discretion. AFT HQ has NOT said that this is their stance, and most likely when it does get around because of all the chicken littles freaking out on the guntoob, it will probably get backtracked until a new regime/administration that is not as pretending to be gun friendly comes in.

I bought my AR pistol already braced. I don't like the brace I have, but yours looks like a brace I could use. That is the kind that spreads over your arm from the top, down both sides, right? I have basically one hand that works. So that kind of brace would be awesome.

The brace I have wouldn't be fun to try to shoulder. It's hard and thin. If I have to shoulder it in order to use it, I may as well put an M4 stock on it. Then I could put a forward grip on it too, although that may not help anything has I only have about 10 to 11% of the grip strength I am supposed to have in my left hand. The bones grind in my thumb and wrist when I try to grip anything. I haven't been able to play guitar for two years.

So is this to say that If I were to get a brace like that, and shoot one handed with with it, that that is now a rifle? It seems to me that someone needs to bring a lawsuit under the Americans with Disabilities Act as that kind of brace would specifically aid a disabled shooter.

That's the kind of brace I want, but I am not gonna waste my mine on one of if I am going to have to SBR my pistol.

The kind of brace on mine would require me to secure a Velcro to my right arm with my left hand, and that I cannot do. But the brace in your pic I could just slide my arm into. Wouldn't even need the Velcro maybe.

I wouod suggest the tailhook or tailhook mod 2. No strap needed. it acts like a cantilever.

The tailhook mod2 compact (they also make mod2 regular which is more expensive) with buffer tube can be found for $45-$65, complete with buffer spring and buffer (which can be removed if desired).

It comes without folding adapter
But you can add one if desired

I tried using a brace as intended. Works ok if I want to shoot with my arm pointing out to my right side. Otherwise there's no way to get my eyes to line up with a sight.
If I only had one arm, or the use of one arm, it might prove useful. As it is I only see braces as a "workaround" instead of SBR-ing your pistol. I've got no issue with that, as that's exactly what I used my brace for.
@1911Fanatic , I have a Sig brace that is similar to the top one shown above. If it interests you, I'd let it go very cheaply.
