I think I've put enough effort in to say Im giving up on this issue.
to summarize, ATF does not deal with state laws at all, so they will not give any advice on 941. Attorney general and state reps dont respond to questions or refuse to answer
Finally got a call back from OSP today. You can only sign up for FICS with a 01 FFL, you cant do a background check on yourself anyway. So they would not let me get a FICS account with an 03 FFL.
OSP says anything related to the C&R FFL has to go through the ATF - thus a complete circle. The manager says he does not know much about the C&R anyway.
2 attorneys I've talked to say you need background checks with the C&R FFL, though one said "you would probably win" if I got arrested.
I asked one to to pursue a declaratory judgement (getting an opinion from a judge without having to get arrested first) and they did not recommend trying.

I did not push it since if the judge ruled against us, it would really make things worse.
There really isnt the benefit of the C&R FFL to risk it in my opinion. Im sure most people are still going to use it under the radar or just not even know enough about 941 to care. But I wont risk it.
I'll probably keep the license for the discounts but not renew when it is due.
my reps are not responding to me about getting an amendment next year. So this might be something you guys work on with your reps.
What a joke. These people pass laws and have no clue what they're talking about. The people in charge of enforcement of the law have no idea what they're talking about. And yet, if we make a mistake and exercise our rights under this license, we pay for it (likely). What a load of carp.
Thanks for doing so much research and sharing it here Bolus. I don't know that there would be anything more you could do to clarify this. I swear, politicians really don't have the qualifications to write laws. What a mess.
Its like that with most laws they pass, however this is particularly volatile because they are stumbling over our Constitutional rights with their head up their asses and many are oblivious that their heads are now lodged permanently up there.

Come on guys. You have to have someone at the firearms division in the Oregon State Police department that has heard of an 03 FFL, especially after I've called like 20 times.
I got to leave a message with the director "who will certainly call you back this week" Same guy I've left 3 messages with who has not called me back yet.
I also left a message with the attorney general. "Hey, ATF contacted you guys to clarify this, have you done it yet?" Just a response that they would get back to me.
Just an idea, Oregonian could probably make a good article out of this. Eg "Attorney General refuses to clarify new law; leaves collectors in limbo"

Currently OSP/AG are probably just hoping the 03 licensees will stop renewing and save them the trouble of doing their job. Likely continue unless they receive media or congressional attention.

If they took he time to listen to people; bring them in to discuss the problems this unconstitutional law would create, a remedy for this issue would be in writting.
$1,000.00 question; are there any lawsuits being put together to turn this law around? We may not have a fringe-bloomie, but we may be able to put our money together....
