Because the McCleary decision is from the Washington Supreme Court interpreting the Washington State Constitution. The Washington Supreme Court is the final authority on state constitutional issues. The federal courts have no ability to review those decisions. Thus, there is nowhere to "challenge" it.

So what has happened with the initiative that would make Seattle its own county?? Is that going to be on a ballot there???
