What modes of conveyance subject me to DUII?

    I live in Corvallis, and have been told that I can get a DUI for riding my bike drunk. I searched the Corvallis Municipal code and found nothing of the sort. Still doesn't mean it couldn't happen, but I didn't see anything.

    Obviously, operating a motorized vehicle while above .08 is grounds, and I have heard everything from bicycles to horses are included too, but have yet to see the actual law on the matter.

    So, can a legal eagle provide me with the City, County, or state statues that might apply?

    I think that operating any vehicle intoxicated is against some staute (bike, skateboard, horse).

    I dont remember what level this is on tho, probably the same level that DUI's are on.

    Look it up, you can on any vehicle.

    Even a skateboard!!!!

    Yup, that's what I found. Anything used for transportation, regardless of power source is defined as a "Vehicle". This apparently would include wheelchairs, horses, skateboards, and probably even crutches too...

    Oddly enough, according to the implied consent law, you are only required to submit to a breath test if operating a motor vehicle. Additionally, refusal to submit to a field sobriety test is merely uses as evidence in court and cannot affect your license.

    Yeah there are some dumb laws out there, and if you walk home, you can get public drunkenness.

    Long ago, I spent fifteen years living in and around Corvallis. That city is truly in its own reality. A friend was arrested for being a drunken PASSENGER in a car where the driver was pulled over and found not to be drunk. My friend was not allowed to walk home from the car stop---ONE BLOCK! I once got a ticket for parking sixteen inches into a "red zone", not even a fire hydrant, just red curb paint.

    However, you can get away with anything in Corvallis: just join a fraternity house, you have a pass on any misdemeanors.

    Now if you REALLY want to get noticed in Corvallis, just carry a lunchbox and wear a hardhat in broad daylight! I think that is still illegal there.......................elsullo :p

    Yeah you can also get parking ticket for being parked in the same spot for more than 48 hours on any residential street.

    Pretty much the most ridiculous cops here.

    .01 to be exact, DUII is driving under the infuence of intoxicants. at .01 you are under the infuence and can recieve a DUII. It happened to me. .07 .08 is just where you are classified as intoxicated. Be carefull. I am still dealing with it almost 3 years later.:(
