1 AN ACT Relating to requiring universal background checks for
2 firearms transfers; amending RCW 9.41.080; creating a new section; and
3 prescribing penalties.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
5 NEW SECTION. Sec. 1. The legislature finds that there is broad
6 consensus that certain people, such as felons, minors, and
7 involuntarily committed persons, should not be eligible to possess
8 firearms for public safety reasons. Background checks are an effective
9 and easy mechanism to ensure that firearms are not sold to those who
10 are prohibited from possessing them. However, because background check
11 requirements apply only to transfers by licensed firearms dealers, many
12 firearms are currently sold without a background check, allowing felons
13 and other ineligible persons to gain access to them. The legislature
14 intends by this act to strengthen our background check system by
15 broadening the requirement for a background check to apply to all
16 firearms sales in the state.
17 Sec. 2. RCW 9.41.080 and 1994 sp.s. c 7 s 409 are each amended to
18 read as follows:

1 (1) No person may deliver a firearm to any person whom he or she
2 has reasonable cause to believe is ineligible under ((RCW 9.41.040))
3 state or federal law to possess a firearm. Any person violating this
4 ((section)) subsection is guilty of a class C felony, punishable under
5 chapter 9A.20 RCW.
6 (2)(a) No unlicensed person may sell a firearm to another
7 unlicensed person unless the purchaser has undergone a background check
8 in accordance with the provisions of this subsection (2) and the
9 purchaser is not ineligible to possess a firearm under state or federal
10 law.
11 (b) A seller of a firearm to an unlicensed person shall request a
12 background check of the purchaser or transferee from a dealer or from
13 the chief of police or the sheriff of the jurisdiction in which the
14 seller or the purchaser resides. The background check shall include a
15 check of the national criminal instant background check system.
16 (c) The purchaser must complete an application to transfer a
17 firearm. The application shall be provided to the dealer or the chief
18 of police or sheriff conducting the background check.
19 (d) The department of licensing shall create and make available an
20 application to transfer a firearm for use by unlicensed persons engaged
21 in the sale or purchase of a firearm. The application shall include
22 the information required under RCW 9.41.090 for an application to
23 purchase a pistol from a dealer, and any other information the
24 department of licensing determines is appropriate.
25 (e) A dealer or a chief of police or sheriff who conducts a
26 background check for an unlicensed person under this subsection (2)
27 must indicate on the application whether the purchaser is eligible or
28 ineligible to possess a firearm under state and federal law based on
29 the results of the background check. A dealer or a chief of police or
30 sheriff may charge a fee for conducting the background check in an

I read the first post and was about to write that this is disguised registration. Guess it is not that well disguised.

Checking for a criminal background is one thing. Tracking purchases of those who pass the background check is a different monster.
 
They just can't get enough gun control. Which is really about people control.

Resist it all now since its clear that its part of Obama's agenda to register all firearms and we know where that leads.

There are 20,000 gun control laws on the books already and they don't enforce half of those. This move was in the cards all along with this administration and they are using this emotional climate to link up all the liberal state legislatures to push a agenda that was in the planning stages following the 2008 election. Note that its active in NY, NJ, CT, IL, CA, CO, MD and a couple of other states. They intend to milk this cow dry, so as gun owners we should link up and not give one inch.

Push back hard in any way you can. E-mails, letters, protests, join a gun organization, etc .

they may have to do a bc but can not be charged for having a gun and selling it to someone yea that sounds logical
 
I've been writing my reps, sadly one is Kagi who is a co sponsor, and have been using the arguments that criminals will still find ways to buy without a background check and it would be unenforceable without registration (which must not happen) and therefore only makes things more difficult for law abiding citizens plus they would now have to pay a fee for a RIGHT which is the same thing as a poll tax which has been ruled as unconstitutional. Anyone have any other good arguments we could use against this?

MESSAGE: While I believe no felons, minors, and involuntarily committed persons, should be eligible to possess firearms; there is a better way to perform the necessary background checks than what is listed in HB1588. Simply have the department of licensing perform a background check during drivers license renewal, and mark on that license whether or not the person is eligible to own a firearm. This would go onto everyone's license; therefore you wouldn't be singling out gun owners. The mark can be made on the back under the "RESTRICTIONS:" section, something like F - Firearms Restricted.

Then make it illegal for anyone to sell a firearm to someone without verifying their drivers license firearms eligibility. If a person does not have a drivers license or similar type ID card, then a background check through a dealer or the chief of police or sheriff would be warranted.

If a person becomes ineligible by committing a felony or being committed, their drivers license would be revoked and they would need to get an updated replacement.

Hey everyone, I've been trying to come up with the best letter I could to combat HB 1588 for universal background checks. below is what I have so far and will be sending to my reps and everyone that has signed off on the bill so far (can be found in this thread http://www.northwestfirearms.com/legal-political/122553-washington-hb-1588-contact-info.html). Please feel free add or edit and then upload different versions if you feel it is better.

I am writing to express that in no way should you support house bill 1588 requiring universal background checks.
1. This bill is far too reaching. Currently Concealed Pistol License (CPL) holders do not have to submit to a background check when purchasing a firearm through a dealer. This bill does not include this exception nor does it include an exception for giving or selling a firearm to a family member or inheriting a firearm.
2. It is already against federal law (and state law) to knowingly sell, trade, give lend, rent or transfer a gun to someone they know or should have known was not legally allowed to possess a firearm.
3. This bill would essentially require ALL sales and transfers be subject to a $20 fee plus additional taxes and fees plus any charges imposed by the Federal Bureau of Investigation. This is essentially a tax on a RIGHT much like a poll tax which has been deemed by the Supreme Court to be unconstitutional. In order for this bill to be constitutional it must be FREE and not create an undue burden for a background check to be run. As such in order for this bill to go through the STATE would need to pay FFL’s for the background check fee and not the buyer or seller. This state already has a budget deficit and we do not need to be wasting anymore of taxpayers money.
a. An alternative would be to setup a system in which people could apply for a free background check card similar to a CPL but would not require fingerprinting and would not allow for concealed carry. However, voter ID laws are highly controversial and setting up such a system would raise the same questions about undue hardship. This would also be added costs and regulation requirements for the state.
4. This bill essentially creates a registry which is illegal under the "Firearms Owners Protection Act of 1986" which states "No such rule or regulation prescribed [by the Attorney General] after the date of the enactment of the Firearms Owners Protection Act may require that records required to be maintained under this chapter or any portion of the contents of such records, be recorded at or transferred to a facility owned, managed, or controlled by the United States or any State or any political subdivision thereof, nor that any system of registration of firearms, firearms owners, or firearms transactions or disposition be established. Nothing in this section expands or restricts the Secretary's authority to inquire into the disposition of any firearm in the course of a criminal investigation."
a. In this bill it calls for the department of licensing to create an application form to include information required under RCW 9.41.090 for an application to purchase a pistol from a dealer AND any other information the department of licensing determines is appropriate. In RCW 9.41.090 for an application to purchase a pistol from a dealer the information required is " full name, residential address, date and place of birth, race, and gender; the date and hour of the application; the applicant's driver's license number or state identification card number; a description of the pistol including the make, model, caliber and manufacturer's number". This bill requires this information be gathered for all firearms and not just pistols and does not setup any guidelines to destroy the application. With the NICS system it is required by law that all records be destroyed within 24 hours. By creating a separate application process through the state with no guidelines for destruction in conjunction with all the information required this creates a universal registry which as stated is illegal.
5. This bill would be unenforceable. As stated above it is already illegal to sell to someone who you know or should know is unable to legally own a firearm. Criminals will still find ways of purchasing firearms without having a background check run.
6. This bill also does not outline anyway for someone who is flagged as ineligible to purchase a firearm to be investigated for an attempt to purchase a firearm illegally. In 2010, out of 76,000 denied purchasers, only 44 were prosecuted nationwide for illegally attempting to purchase a gun. If you are not going to crack down on those attempting to purchase a firearm illegally then what is the point of creating another law?
a. If someone is denied purchase it should be law enforcements job to notify the applicant. Under this bill it simply states that a denied result needs to be listed on the application leaving the seller to have to notify the individual of the denial. This could potentially cause safety issues for the seller if the denied party decides to retaliate or attempts to steal the firearm from the seller
7. This law does not address any protection for the seller from prosecution if the buyer is not legally allowed to possess a firearm but uses a stolen identity or provides false information on the background check form.

Please do not support this bill or any other bills which would further infringe on our second amendment rights.

State Representative Matt Shea just responded to a letter I wrote to say his office has been "overwelmed with opposition" letters to HR1588. He said he hopes all the other representatives have received the same feedback.

The history of fees in this state should tell you it will be increased if this law passes. I'll bet you can count on sales tax being added too. Remember up until last year when you shipped a weapon into the state from Gun Broker or somewhere, there wasn't any sales tax collected. The past governor changed that and I don't see anyone would change it now. Private sales would just be to easy for them to pass up.

I don't see it as being just a background check. They will collect the seller's name and location plus the buyer's name and location along with the serial number of the weapon. Want to pass your collection on to you son or daughter? It'll cost you and then the serial numbers will all be recorded and maintained by the State. Washington does it now for handguns and I have always wondered why none of us protested them keeping the information on file.

And before anyone writes me about this being stupid and they won't do it. I think that's pretty obvious between relatives and "good" friends most of us won't. The problem will be anynew firearm purchased will now be permanently recorded and maintained by the State. We need to protest this proposal and keep it from passing.
