Inslee issued a new list of "essential" businesses. I don't see firearms dealers as being allowed to operate. Do you?

It seems to me that Inslee has achieved his dream of shutting down firearms owner transactions simply by excluding firearms dealers from this list. This is much easier for him than getting a bill passed in the legislature or via billionaire funded initiative. I think this is something that the SAF should be examining as a constitutional challenge.
 
I find it strange that the 2AF hasn't brought suit against Jerkoff Jay yet. They've already threatened and/or sued PA, NJ, DE, PDRK, NOLA and yet, haven't really done much in their home state. My hope is that the 2AF will soon announce either a lawsuit or a change in WA's essential list.

I do have to keep laughing when I see these people threaten jail for those who tell them to pound sand since they are also wanting to kick people out of the jails. So far I have yet to see any real news of anyone being arrested. I suspect the people in power are hoping the threat will make people do as told. It will come down to how long till they see mass refusal to cooperate. Last couple days when I drove home from work the traffic was close to the days before this started as to how heavy it was. Looks like a lot of people are already deciding to ignore the orders here.

Pastor Tony Spell, head of Life Tabernacle Church in Central, carried on with a scheduled service Tuesday despite being issued a misdemeanor summons for ignoring a state-wide order barring large gatherings just hours earlier, police say. Authorities charged Spell with six counts of rule violations — one for each of the six services he's held at his Central campus these last two weeks.

Those cited will make some interesting court cases if they chose to fight this. Will be fun to see this play out. WA has been under a stay home order for a while but so far I am not seeing anyone here being arrested. I doubt I will see any.

There are complex legal hurdles to files a lawsuit in federal court. The attorneys and I have been discussing this for 4 weeks. SAF has approved filing the suit, its drafted, its even been floated past the AGs office. That's why they haven't come out an explicitly said firearms sales must stop. Trust me, there is a ton of desire to file, but it needs to be done correctly, otherwise it's showboating and established bad case law on a 2A issue. Go slow and win, don't try to be the first loser!

Thanks for the update, and well said--too many of our brethren only have the attention span for a boxing match, and don't understand or appreciate how important meticulous, time-taking planning is to getting a final Checkmate.

In short, our strategies need to be less George Foreman and more Garry Kasparov or Bobby Fischer.

Now, I see an article on Seattle Times which provides additional insight Some Washington gun dealers keeping stores open, defying Inslee's order amid coronavirus outbreak It looks like dealers are open and daring Inslee and Ferguson to attempt a closure enforcement action.

The situation could get more contentious. The Bellevue-based Second Amendment Foundation (SAF) is prepared to file suit against Inslee if gun stores are forced to close, according to the organization's founder, Alan Gottlieb.

"Gun stores are still open and the state is doing the background check for sales and transfers," wrote Gottlieb. "As soon as it is ripe we will file. Plaintiffs and complaint are ready!"
 
Agreed as we have found out painfully in the past, as I sit here looking at my newly arrived in the mail request for money from the SAF I can't help but wonder why there have been lawsuits filed in other states yet not here! I cannot go purchase a gun right now as the Whatcom Co. Sheriff and Bellingham PD locally are not processing background checks. I suppose I could travel to another county. So preemption is no longer law here in Washington! The point in this is that I have no answers and as the CEO of a 2500 member gun club here in Whatcom Co. I am getting calls daily asking these questions and there is no place to get a straight answer. I get it you may not want to publicly disclose the strategy feel free to PM me. I am thankful for your efforts Dan and please don't read this as a dig on you or SAF a great many of us out here would gladly reach deeper in our pockets if we had a clue what was going on! Do we in localized areas that are being infringed need to spend our money locally and sue ourselves??

flydipper, my interpretation of what is going on is this: 1) If SAF files a lawsuit before the state makes an explicit enforcement action that shuts a dealer down, the lawsuit would get tossed. 2) The state would provide a defense of "we haven't enforced this proclamation", the the judge would throw it out. This is what has happened in the past.

I don't think SAF would file a lawsuit on the basis of a business voluntarily shutting down out of fear that they might be prosecuted (which might be your situation). But, you can always ask SAF to see.
 
My FFL just had a conversation with WCSO and they will not give a straight-up yes or no!

flydipper, I hope you send that to SAF and ask them what to do. It looks like the Sheriff is afraid to take a stand. SAF may ask you to go ahead and attempt to make the purchase and force the issue.
