Washington Gun Law President, William Kirk, discusses what actually constitutes a loaded gun under Washington law. Knowing that we cannot carry a loaded firearm in our car unless we possess a valid concealed pistol license (RCW 9.41.050) and that we can NEVER carry a loaded rifles or shotgun in our car (RCW 77.15.460). Today we take a look at what really constitutes a loaded gun depending on its platform. Arm yourself with knowledge today in just over 2 minutes.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Period.

Loaded = magazine in gun, ammunition in magazine.

Chambered = ammunition is in the position it can exit the barrel if fired.

Though many people use the term "loaded" to describe, "chambered."

The real take away is to trust no one to handle guns around you that isn't very adept in how to handle guns safely, follow the rules of firearm safety, and clear guns (inspect for yourself if someone else clears it) before handling them for reasons other than shooting.

Kirk said a semi-auto handgun with a magazine in the magazine well is considered loaded.

That is not what the law says.

Whether or not the magazine contains cartridges makes a world of difference.

Never trust a lawyer - especially one that speaks before he thinks.

You are right. Ammunition being present obviously is relevant.

People need to read the RCW's for themselves and quit relying on other people to summarize it for them.

Seems like this lawyer frequently doesn't quite know what he's talking about.
