Any criminal law breaking can result in the death penalty. I know it is unlikely and that this is a bit of a stretch, but ... some LEO having a bad day might end your life over the infraction. Remember the guy selling "onesy's" that is single cigarettes? Dead. No one got up, punched in thinking I'll kill some low-life today. Yet it happened.
 
IMHO, the slippery slope began with distortion of the meaning of :

".....shall not be infringed."
